Beau chane 67 Camden Avenue North Brooklyn Center, MN 55430 March 12, 1983 Mr. Gerald Splinter, City Manager City of Brooklyn Center 6301 Shingle Creek Parkway Brooklyn Center, MN 55430 Dear Jerry, As we discussed by phone, the Charter Commission is scheduled to meet on March 23, 1983. At that meeting, we would like to review the draft of the proposed wording changes to the Charter that you were going to prepare If you have some language drafted, we would appreciate an opportunity to begin our review of it. In addition, the Commission is interested in any thoughts you may have regarding the proposal to adopt a policy with respect to ethics. We understand that you may not have reached a conclusion, but if you could share your thoughts with me or the Commission, we would appreciate it. Lastly, we have three small questions that we would like your help with 1) Charter Section 3.30 states that the Council may provide an ordinance which would provide a means whereby a minority of the Council could comment the attendance of an absent member. Has such a mechanism been put into place? 2) Section 7.16 by our understanding is unnecessary. In researching why this section was never deleted, we note that the January 17, 1979, Council minutes state that the City Attorney would comment. We have no record of such comment and wonder whether or not this section is of any value. 3) Section 12.02. We understand that there has been a re- cent Supreme Court decision with respect to oaths and what may be compelled of an individual. We wonder whether the Supreme Court ruling would have any impact on the oath of a municipal officer.
