HomeMy WebLinkAbout1975-036 CCR Member Robert Jensen introduced the following resolution and moved its adoption: RESOLUTION NO.__7.S -:36 RESOLUTION DENYING REQUEST FOR LICENSE FEE REBATE, WHEREAS, Mr. Edward C. Haugh made application to the City of Brooklyn Center for a nonintoxicating on -sale liquor license in the amount of $250.00 and various other licenses in the amount of $42.00 as a prospective buyer of the Chuck Wagon Inn; and WHEREAS, said applicant has decided not to purchase said establishment and requested a rebate of the total amount of license fees; and WHEREAS, the City Council at the January 6, 1975 meeting directed the City Attorney to research the legality of such a rebate; and WHEREAS, upon completing said research it was found that Section 340.02, Subdivision 11 of M.S.A. allows for the rebate of nonintoxicating liquor licenses only under circumstances of death or illness of the applicant, destruction by fire of licensed premise or change in the licensing law; and WHEREAS, Section 23 -009 provides for no refund of any license fee upon revocation or voluntarily ceasing to carry on the licensed activity: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the request for rebate of license fees by Mr. Edward C. Haugh be denied. January 20, 1975 Date Mayor ATTEST: v Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Tony Kuefler and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Maurice Britts, Tony Kuefler, Bill Fignar and Robert Jensen; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
