adoption:
RESOLUTION NO. 75 -60
RESOLUTION OPPOSING SENATE FILE NO. 939 RELATING TO
HOUSING AND ESTABLISHING STANDARDS FOR BUILDING
AND ZONING RESTRICTIONS
WHEREAS, Senate File No. 939 purports that the high cost of housing in
Minnesota is due in part to unreasonable construction standards; and
WHEREAS, the bill further purports that municipal land use and development
controls need to be regulated by the Legislature and the Metropolitan Council to
permit "reduced cost housing and
WHEREAS, Senate File No. 939 proposes to stimulate construction of new
housing and rehabilitation of old housing through a tax rebate system during the
ensuing two year period; and
WHEREAS, Senate File No. 939 proposes to confer upon the Metropolitan
Council the authority to impose standards and criteria and model ordinances for
land use and development controls upon metropolitan municipalities so that
"reduced cost housing" can be built; and
WHEREAS, Senate File No. 939 mandates that said standards and criteria
establish, among other things, minimum lot size, minimum floor area, and on
allowable apartment density of twenty units per acre which is twenty -five per cent
greater than authorized by Brooklyn Center's Zoning Ordinance; and
WHEREAS, Senate File No. 939 would mandate that municipalities must
set aside, apparently through zoning, designated amounts of available developable
residential land for such "reduced cost housing":
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center to oppose Senate File No. 939 because it represents an overly
simplistic solution to a complex problem.
BE IT FURTHER RESOLVED that the Brooklyn Center City Council deplores
and rejects the implications contained in Senate File No. 939 to the effect that
Brooklyn Center's Zoning Ordinance, the State imposed Building Code which the
City administers, the City Subdivision Code, and the development decisions made
by the Brooklyn Center City Council are unreasonable so as to be blamed for the
high cost of housing.
BE IT FURTHER RESOLVED that the attitude reflected in Senate File No. 939
represents a departure from the state -local partnership attitude existing and
developing in many state agencies and departments.

BE IT FURTHER RESOLVED to express the opinion that Senate File No. 939 is
representative of all too frequent tendencies of the remote and often unresponsive
levels of federal and state government to consume traditionally local decision- making
authority and thereby effectively deprive citizens an opportunity to directly influence
their local affairs.
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the
Governor of the State of Minnesota, to Minnesota legislators representing the City
of Brooklyn Center, and to legislative members of the Minnesota Senate Metropolitan
and Urban Affairs Committee.

The motion for the adoption of the foregoing resolution was duly seconded by
member Bill Fignar and upon vote being taken thereon, the following voted
in favor thereof: Philip Cohen, Maurice Britts, Bill Fignar and
Robert Jensen;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
