RESOLUTION NO. 75 -66
RESOLUTION OPPOSING S.F. 998 RELATING TO THE STATE
BUILDING CODE
WHEREAS, S.F. 99 8 expands upon present statutory mandate that
Minnesota municipalities conform to the State Building Code; and
WHEREAS, such expansion includes the general provision that would
authorize municipalities "to adopt and enforce individual building maintenance
codes so long as the codes do not exceed the requirements of the State Building
Code and
WHEREAS, such expansion further prohibits any other State agency or
department from adopting rules and regulations "involving building codes
subject matter" without consultation with the Commissioner of Administration,
without definition of the term "involving and
WHEREAS, it is the longstanding experience of Brooklyn Center and
other responsible local units of government that the State administration of
the State Building Code in its present scope is conducted in an often insensitive,
indifferent manner to the detriment of the citizens of Minnesota and to the
enhancement of the economic interests of the Minnesota building industry; and
WHEREAS, there is reasonable apprehension that similar insensitive
and indifferent interpretations and practices applied to building maintenance
codes would have the significant effect of destroying an emerging state -wide
policy of preserving Minnesota's existing housing stock through such building
maintenance codes:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center as follows:
1 To adamantly oppose the delegation of authority sought by the
Commissioner of Administration as embodied in S.F. 998 and
to urge instead that the Legislature scrutinize and possibly
investigate details of the administration of the State Building
Code during recent years with particular emphasis on the
domination of such administration by the narrow economic
interests of the building industry.

2. To direct that copies of this resolution be transmitted to the
Governor of the State of Minnesota, to members of the State
Legislature representing the City of Brooklyn Center, to
members of the Senate Governmental Operations Committee
and to the Commissioner of Administration.

The motion for the adoption of the foregoing resolution was duly seconded by
member Tony Kuefler, and upon vote being taken thereon, the following voted
in favor thereof: Philip Cohen, Maurice Britts, Tony Kuefler and Bill Fignar;
and the following voted against the same: Robert Jensen; whereupon said
resolution was declared duly passed and adopted.
