adoption:
RESOLUTION NO. 75 -72
RESOLUTION OPPOSING H.F. 1159 REGARDING OVERDUE
MUNICIPAL UTILITY PAYMENTS
WHEREAS, H.F. 1159 would prohibit municipal public utilities from
assessing a late payment charge of more than 1% per month on the overdue
balance of a utility bill and would prohibit municipalities from certifying such
past due utility bills to the tax rolls for collection; and
WHEREAS, enactment of H.F. 1159 would produce the effect of forcing
municipalities to expend funds for strengthening its collection procedures and
possibly contracting with private collection agencies; and
WHEREAS, it can, therefore, logically be asserted that H.F. 1159 would
have the net effect of leading to increased water and sewer rates to be paid by
all customers for the purpose of subsidizing collection costs which need not now
be incurred:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center:
1 To oppose H.F. 1159 to the extent that it would prohibit
collection of overdue municipal utility bills through use
of the tax rolls and to urge legislators to reconsider the
legislation on the basis of the overall detrimental effect
to customers of municipal utilities.
2. To direct that copies of this resolution be transmitted to
the Governor of the State of Minnesota, to members of
the State Legislature representing Brooklyn Center, to the
authors of H.F. 1159, and to members of the House Local
and Urban Affairs Committee. f
