adoption:
RESOLUTION NO. 75 -83
RESOLUTION AUTHORIZING RETROACTIVE COMPENSATION
TO POLICE DEPARTMENT EMPLOYEES
WHEREAS, on July 8, 1974, the City Council adopted Resolution No.
74 -109 approving a 1973/74 labor agreement between the City of Brooklyn Center
and the Brooklyn Center Police Association; and
WHEREAS, said labor agreement provided that the terms thereof be
effective retroactively to January 1, 1973; and
WHEREAS, members of the Police Association bargaining unit were
compensated at 1972 wage rates from January 1, 1973, pending final negotiations
of the labor contract; and
WHEREAS, the City Manager sought a legal opinion regarding the legal
authorization to pay retroactive wage increases to two former bargaining unit
members who terminated employment April 22, 1973 and June 28, 1973
respectively; and
WHEREAS, the resulting legal opinion provided that the terminated
bargaining unit members are entitled to retroactive wage increases between
January 1 1973 and the dates of their termination, to the extent that contract
retroactivity applies to other bargaining unit members; and
WHEREAS, the resulting legal opinion more broadly provided that wage
increase retroactivity was valid only to the extent and from the date that there
was any assurance or understanding of retroactivity conveyed to the employees
by the employer; and
WHEREAS, Resolution No. 72 -208 adopted December 19, 1972, states
that "the City Council, in recognition that certain salary rates have not yet
been successfully negotiated in the Departments of Police, Parks and
Recreation and Public Works, have extended 1972 salary rates for related job
classifications with the intent of making appropriate amendments upon com-
pletion of negotiations.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center to interpret the phrase "with the intent of making appropriate
amendments upon completion of negotiations" contained in Resolution No.
72 -208 as implying retroactivity from January 1 1973 until settlement of the
negotiations.
RESOLUTION NO. 75 -83
BE IT FURTHER RESOLVED to authorize payment of gross compensation in
the amount of $329.96 retroactive payment to former bargaining unit member
Everett Waters for the employment period January 1 1973 through June 28, 1973
and $212.33 retroactive payment to former bargaining unit member William
Dingman for the period January 1 1973 through April 22, 1973.
BE IT FURTHER RESOLVED to fund the foregoing by directing a transfer
of $543.00 from unappropriated surplus (Account No. 01 -2600) to the Police
Department appropriation (Account No. 01 -4100- 000 -31).

The motion for the adoption of the foregoing resolution was duly seconded by
member Robert Jensen, and upon vote being taken thereon, the following voted
in favor thereof: Philip Cohen, Maurice Britts, Tony Kuefler, Bill Fignar and
Robert Jensen;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
