HomeMy WebLinkAbout1975-100 CCR Member Tony Kuefler introduced the following resolution and moved its adoption: RESOLUTION NO. 75-100 RESOLUTION AUTHORIZING THE PURCHASE OF MINN. OSA -82 PARCELS 4 AND 4A INCLUDED IN THE CITY OPEN -SPACE APPLICATION AND PAYMENT OF RELATED COSTS WHEREAS, the City of Brooklyn Center desires to acquire lands to be preserved for permanent open -space use and has made application to the Federal Government for financial assistance therefor under Title VII of the Housing Act of 1961 as amended; and WHEREAS, on May 26, 1969, the City Council adopted Resolution No. 69 -242, authorizing the City to enter into a contract with the Federal Government for said financial assistance; and WHEREAS, the contract for said financial assistance identified as Contract No. Minn. OSA -82 was executed by the City and the Federal Government on March 27, 1970; and WHEREAS, on the 6th day of May, 1969, the City Planning Commission reviewed the following parcels and thereupon adopted a resolution approving the acquisition of said parcels and stating that such acquisition was in conformance with the Comprehensive Plan for the community; and WHEREAS, as required by regulations adopted by the Department of Housing and Urban Development applicable to land acquisitions under the aforementioned Title VII, two appraisals have been obtained, said appraisals being on file in the Office of the City Clerk; and WHEREAS, pursuant to regulations adopted by the Department of Housing and Urban Development, the purchase of said parcels has been negotiated and subsequently entered into eminent domain proceedings with the Commissioners awarding total damages of $38,000.00 on February 11, 1972; and WHEREAS, on April 24, 1972, by Resolution No. 72 -55 the City Council authorized payment of 75% of said amount together with certain costs as follows: Pavee Amount File No. Parcel No. Purpose The Clerk of District Court, Hennepin Co. $28,119.14 C1 -107 A and B 75% of damages Richard H. Wilson 600.00 C1 -107 A and B Appraisers Fees RESOLUTION NO. 75 -100 WHEREAS, the property owners appealed from said award of damages and on May 23, 1975 a jury of six persons entered a verdict of $35,000.00 total damages together with certain expenses allowed by statute, NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Brooklyn Center authorizes the following payments based upon the jury verdict: Payee Amount File No. Parcel No. Purpose Keith T. Wilson, Appraiser 250.00 C1 -107 A and B Fees and Mileage Richard Ernst, Expert Witness 300.00 C1 -107 A and B Fees and Mileage June 2, 1975 Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Bill Fignar and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, Tony Kuefler, Bill Fignar and Robert Jensen; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
