HomeMy WebLinkAbout1975-101 CCR Member Tony Kuefler introduced the following resolution and moved its adoption: RESOLUTION NO. 75 -101 RESOLUTION REGARDING DISPOSITION OF AMENDMENTS TO PLANNING COMMISSION APPLICATIONS NO. 72010 AND NO. 72069 SUBMITTED BY THE DIETRICH COMPANY WHEREAS, the City Council on May 19, 1975 considered amendments to Planning Commission Application No. 72010 (site and building plans) and No. 72069 (subdivision) submitted by the Dietrich Company for the townhouse project located westerly of T.H. 152 at Wingard Lane; and WHEREAS, the subject applications were originally approved on February 28, 1972 and on September 25, 1972 (with final plat approval on November 20, 1972), respectively; and WHEREAS, said amendments involve construction on and necessary replatting of Blocks 6, 12, 13, 14, 15, 16, 17, 19, 20, and 22, Creek Villas Addition; and WHEREAS, public testimony was taken as to the design of the proposed amendments; and WHEREAS, the developer presented the amended plans including specification of the location of certain proposed single level units; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center: That pursuant to the requirements of Chapters 15 and 35 of the City Ordinances, amendments to Planning Commission Applications No. 72010 and No. 72069 are hereby approved as submitted, subject to the following conditions: 1 Building plans are subject to review by the Building Official with respect to the applicable codes prior to the issuance of building permits. 2. Grading, drainage, utility and berming plans are subject to review by the City Engineer prior to the issuance of permits, and necessary utility line revisions shall be approved by the City Engineer with respect to applicable codes. 3. A performance agreement and a financial guarantee (in a form and amount approved by the City Manager) shall be submitted to assure completion of approved site improve- ments for the project, prior to the issuance of permits. RESOLUTION NO. 75 -101 4. The site shall be replatted according to the approved plans, and said plat will be subject to the following: a. Review by the City Engineer. b. Requirements of Chapter 15 of the City Ordinances. C. A copy of any proposed amendments to the Home- owner's Association document shall be submitted to the City Attorney for review. The final plat shall be filed prior to the certification of occupancy for permitted structures. 5. A minimum of two parallel off- street parking stalls shall be provided on the site of each unit. 6. The location of the proposed eleven single level end units shall be according to the submitted site plan on Blocks 12, 14, 15, 16, 19, and 22. 7. Enhancements to the proposed single level units shall be subject to approval by the Building Official prior to issuance of building permits. 8. Proposed enclosed patio options shall be limited to Blocks 13, 14, 15, and 16. 9. Landscaping and site improvements shall be evaluated in accordance with the approved landscaping plan, and improvements in the developed areas shall be completed no later than October 1 1975 10. Site lighting for the balance of the project will be compatible in design to the completed portion of the project.
