adoption:
RESOLUTION NO. 74 -58
RESOLUTION ORDERING DELETION OF WATER MAIN IMPROVEMENT
PROJECTS NO. 1973 -31 1973 -36 AND STREET RESTORATION
IMPROVEMENT PROTECT NO. 1973 -32 FROM CONTRACT 1974 -A
WHEREAS, on February 4, 1974, the Brooklyn Center City Council awarded
Contract 1974 -A in the amount of $251,458.50 to G. L. Contracting, Inc. on the
basis of said bid being the lowest bid received and being 2% under the Engineer's
estimate; and
WHEREAS, said Contract 1974 -A consists of Water Main Improvement Projects
No. 1973 -6, 1973 -7, 1973 -31 1973 -34, and 1973 -36, and Street Restoration
Improvement Project No. 1973 -32; and
WHEREAS, further review of bids for individual projects indicates that the
bids by G. L. Contracting, Inc. for Improvement Projects No. 1973-31, 1973 -32
and 1973 -36, totaling $43,487.50, exceed the Engineer's estimate by approximately
$7,000, or 19 and the low bid of another contractor by $10,300, or 31 and
WHEREAS, Section 7 -H of the General Conditions of the said contract permits
the owner, through the Engineer, to order work deductions up to 25% of the total
contract price without invalidating the contract; and
WHEREAS, the total cost of work comprehended by said Projects No. 1973-31,
1973 -32 1973 -36, amounting to $43,487.50, constitutes 17.29% of the total
contract amount of $251,458.50;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that the City Engineer is hereby directed to delete
Water Main Improvement Projects No. 1973 -31 1973 -36, and Street Restoration
Improvement Project No. 1973 -32 from Contract 1974-

The motion for the adoption of the foregoing resolution was duly seconded by
member Tony Kuefler, and upon vote being taken thereon, the following voted in
favor thereof: Philip Cohen, Maurice Britts, Bill Fignar, Tony Kuefler and
Robert Jensen;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
