RESOLUTION NO. 74 -82
RESOLUTION REGARDING DISPOSITION OF PLANNING COMMISSION
FILE NO. 71019 AND SCHEDULING COMPLETION OF REQUIRED SITE
AND SAFETY IMPROVEMENTS AT THE STANDARD SOLVENTS COMPANY
WHEREAS, Planning Commission File No. 71019, submitted by Standard
Solvents Co., 4906 France Avenue No. was reviewed and approved by the City
Council on June 14, 1971; and
WHEREAS, said approval stipulated the completion of certain site improve-
ments, including landscaping, paving, and the burial of the above ground storage
tanks within two years, as reflected in the official minutes of the June 14, 1971
meeting; and
WHEREAS, a performance agreement and performance bond (in the amount of
$1 000) were submitted on June 21 1971 to assure completion of required site
improvements; and
WHEREAS, subsequent inspections of the site established that said improve-
ments had not been completed as stipulated; and
WHEREAS, during subsequent review, the City Council voiced particular
concern that above ground bulk storage tanks be buried as a matter of public safety,
citing a February 18, 1974, memorandum from the Fire Chief reaffirming his 1970
recommendation that said tanks were an extreme fire hazard and should be replaced
with buried tanks; and
WHEREAS, during further consideration the City Council received from the
applicant a written proposed schedule, dated April 12, 1974, for the placement of
said tanks underground:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center:
That the site improvements for Standard Solvents Co. 4906 France Avenue No.
as stipulated with the June 14, 1971 approval of Planning Commission File No.
71019, shall be completed according to the following schedule and conditions:
1 The bulk tank storage area shall be appropriately diked by
July 1, 1975 unless sooner specified by the State Fire
Marshall Department.
2. All tanks used for storage of Class IA and of Class IB
liquids will be buried by July 1, 1975.

3. All tanks used for storage of Class IC, of Class II and
of Class III liquids will be buried by July 1 1976.
4. All unimproved driving and parking areas shall be
improved by October 1 19 76 in accordance with appli
cable ordinance requirements and pursuant to plans which
must be submitted for City approval.
S. A performance agreement and financial guarantee (in an
amount to be determined by the City Manager) shall be
submitted to assure completion of all approved improve-
ments cited above.

The motion for the adoption of the foregoing resolution was duly seconded by
member Bill Fignar, and upon vote being taken thereon, the following voted
in favor thereof: Philip Cohen, Tony Kuefler, Bill Fignar and Robert Jensen;
and the following voted against the same: Maurice Britts, whereupon said
resolution was declared duly passed and adopted.
