moved its adoption:
RESOLUTION NO. 74 -28
RESOLUTION ENDORSING THE SHADE TREE DISEASE CONTROL
CONCEPT EMBODIED IN HOUSE FILE NO. 2920
WHEREAS, the City of Brooklyn Center has earlier enacted and caused
the enforcement of an ordinance intended to control Dutch Elm disease and
WHEREAS, the control of shade tree diseases can best be effected
through area wide control efforts:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center as follows:
1. To endorse the general concept of shade tree disease control
as embodied in House File No. 2920.
2. To urge that House File No. 2920 be amended such that the
method of financing the cost of diseased tree removal from
private properties be left to the option of the respective
municipality.
3. To urge that House File No. 2920 be amended to strike the
inappropriate requirement that shade tree legislation enacted
by duly elected local governing bodies be submitted for
unilateral approval or disapproval by a nonelected State
administrative officer.
4. To commend legislators for the provision in House File No. 2920
which recognizes the additional costs to a municipality for such
a mandated program and authorizes such costs to be financed by
a special levy outside existing levy limitations.
5. The legislative representatives of the people of Brooklyn Center
are herewith called upon to support legislation, as qualified
above, and the City Clerk is hereby directed to transmit copies
of this resolution to the aforementioned legislators, the chairman
of appropriate legislative committees, and to the Governor of the
State of Minnesota.

The motion for the adoption of the foregoing resolution was duly seconded by
member Tony Kuefler and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, Maurice Britts Bill Fignar,
Tony Kuefler and Robert Jensen;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
