and moved its adoption:
RESOLUTION NO. 74 -40
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER
MAIN IMPROVEMENT PROJECT NO. 1974 -7, SANITARY SEWER IMPROVEMENT
PROJECT NO. 1974 -8, STORM SEWER IMPROVEMENT PROJECT NO. 1974 -9,
AND PROVIDING FOR REIMBURSEMENT OF UNASSESSED COST OF WATER
SYSTEM IMPROVEMENT PROJECTS
WHEREAS, it is proposed that there be constructed improvement
projects consisting of the following:

900' northeasterly of Summit Drive No. to approx.
2,000' northeasterly, thence westerly on an easement
overlying Outlots C D, B.C.I.P. Plat 1, to a point
on the east right -of -way line of Shingle Creek Pkwy.
lying 471.50' south of the south right -of -way of
F.A.I. 94. $60,000.00
1974 -8 Sanitary sewer in proposed Earle Brown Drive from
approx. 900' northeasterly of Summit Drive No. to
approx. 2,000' northeasterly of Summit Drive No. $15,000.00
1974 -9 Storm sewer in proposed Earle Brown Drive from approx.
900' northeasterly of Summit Drive No. to approx.
2,000' northeasterly of Summit Drive No. $8,000.00
and
WHEREAS, the City Engineer has made a preliminary report advis-
ing that said proposed improvements are feasible and that they can be
constructed at estimated costs as indicated above.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 429, Minnesota Statutes.
2. A public hearing on the proposed improvements shall be held
at the City Hall in the City on Monday, the 8th day of April, 1974, at
8:00 o'clock P.M., central daylight time, and the Clerk shall publish
notice of the time and place of hearing by two weeks' publication in
the official newspaper of the City.
3. The areas proposed to be assessed for said improvements
are as follows:
ALL LOTS AND PARCELS ABUTTING THE ABOVE DESCRIBED STREETS
AND /OR TO BE BENEFITTED BY THE IMPROVEMENTS.

4. These proposed improvements shall be designated Water
Main Improvement Project No. 1974 -7, Sanitary Sewer Improvement
Project No. 1974 -8, and Storm Sewer Improvement Project No. 1974 -9.
BE IT FURTHER RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that it is hereby determined that the
properties which will be served by Water Main Improvement Project
No. 1974 -7 when said improvement is completed will also be benefitted
by Water Improvement No. 1960 -1 and subsequent water system improve-
ment projects for which properties were not initially assessed; and
that as to expenditures made for such improvement projects from general
ad valorem tax levies, Public Utility funds, or other sources and funds
in addition to special assessments heretofore made for said improve-
ments, the City shall be reimbursed therefor by adding an estimated
$30,000.00 to the assessment to be levied for Water Main Improvement
Project No. 1974 -7, and the City Clerk shall cause notice that such
additional amount will be assessed to be included in the notice of
hearing in the making of said Water Main Improvement Project No. 1974 -7.

The motion for the adoption of the foregoing resolution was duly
seconded by member Maurice Britts and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
Maurice Britts Tony Kuefler and Robert Jensen;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
