john Leary introduced the following resolution and
moved its adoption:
RESOLUTION NO. 73_137
RESOLUTION REGARDING STATUS OF EXPIRED PERMITS AND
ADMINISTRATION OF METROPOLITAN SEWER BOARD SERVICE
AVAILABILITY CHARGE
WHEREAS, a number of building permits were issued prior to January 1,
1973; and
WHEREAS, some of those permits were not exercised and have expired,
according to the provisions of Section 3 -103 (F) of the City ordinances; and
WHEREAS, Section 3 -103 (F) provides for renewal of said permits within
one year from date of expiration; and
WHEREAS, it is questionable whether such permit renewals are subject
to a Metropolitan Sewer Service Availability Charge which has been assessed
against new building permits taken since January 1, 1973;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that:
At such time that building permits originally issued prior to
January 1, 1973 (and since expired) may be renewed according
to Chapter 3 of the City ordinances, a full financial guarantee,
in the form determined by the City Manager, shall be required
to assure payment of any Metropolitan Sewer Board Service
Availability Charge which may be legally levied against such
permits; and further, that the amount of said financial guaran-
tee will be returned, if after a reasonable period of time a
S.A.C. is not levied.

The motion for the adoption of the foregoing resolution was duly seconded by
member Maurice Britts and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary, Maurice Britts,
Bill Fignar, and Tony Kuefler;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
