adoption:
RESOLUTION NO. 73 -169
RESOLUTION ESTABLISHING POLICY GUIDELINES FOR
GROUP DAY CARE FACILITIES IN APARTMENT BUILDINGS
AND MULTI RESIDENTIAL COMPLEXES
WHEREAS, Chapter 35 of the City Ordinances provides for child care homes
as special uses in the R -4 and R -5 zoning districts; and
WHEREAS, the City Council has determined the need for local guidelines
concerning the establishment of Group Child Care facilities within apartment
buildings and multi- residential complexes in these districts; and
WHEREAS, said guidelines are deemed necessary for assuring the health,
safety, and welfare of the citizens of the community:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the following guidelines are hereby adopted as the policy
of the City of Brooklyn Center with respect to Group Day Care facilities in
apartment buildings and multi residential complexes:
Group Day Care or Child Care Facilities are hereby subject to the
following guidelines
1 Special Use in the R -4 and R -5 districts.
2. One facility per complex having a minimum of 36 dwelling units.
3. Facility to be located on ground level (first floor) only, safely
proximate to outdoor play areas.
4. Inspections and documentation as to compliance with State
Building Code, Welfare Department and Fire Marshall requirements.
5. Building plan review and approval, as part of special use permit
hearing process, with respect to conversion of existing facilities
(based upon certified plans)
6. Written statement from applicant describing nature of operation;
to include documentation as to need for facility in proposed
location.
7. Written statement from owner of complex acknowledging that
necessary construction or alterations will be permitted.

The motion for the adoption of the foregoing resolution was duly seconded by
member John Leary and upon vote being taken thereon, the following
voted in favor thereof: Philip Cohen, John Leary, Bill Fignar, and Tony Kuefler,
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
