adoption:
RESOLUTION NO. 73 -201
RESOLUTION REGARDING DISPOSITION OF PLANNING COMMISSION
APPLICATION NO. 73029
WHEREAS, Application No. 73029 was submitted on August 13, 1973, by
Mr. Norman Chazin as a petition for rezoning from R -5 to C -2 of the four acre
parcel of land located in the southwest quadrant of the intersection of Trunk
Highway 152 and FAI -94; and
WHEREAS, said petition was presented before the Planning Commission
at a duly called public hearing on September 6, 1973, and was further considered
by the Commission on September 27, 1973; and
WHEREAS, on October 4, 1973, Resolution No. 73 -4 was unanimously
approved by the Commission recommending denial of said application; and
WHEREAS, the petition was heard by the City Council on October 15 and
November 20, 1973:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that Planning Commission Application No. 73029 submitted by
Mr. Norman Chazin be denied on the basis of the following factors:
1. The neighboring property owners' petition, in
opposition to the proposed commercial zoning and develop
ment, which emphasized the residential character of the
area;
l 2. The "spot zoning" nature of the proposal, given
the residential character of the surrounding property, which
resulted in large part from the restrictive covenants placed
on those properties by the owner of the subject parcel;
3. The concerns of the Planning Commission, noted
in the resolution recommending denial, that the proposed C -2
zoning was incompatible with the residential character of the
area;
4. The proposed zoning and development is not
consistent with the Comprehensive Plan which calls for
"Planned Development" of the area, limiting any commercial
development to C -1 type uses;
5. The natural conflict between the intensity of
permitted C -2 uses and single family residential land use.

The motion for the adoption of the foregoing resolution was duly seconded by
member John Leary and upon vote being taken thereon, the following
voted in favor thereof: Philip Cohen, John Leary, Maurice Britts, Bill
Fignar and Tony Kuefler;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
