STUDY GROUP I Brooklyn Center Charter Commision Minutes of Meeting City Hall Library April 12, 1978 Chairman Jim Gillem called the meeting to order at 7:30 P.M. Present were members Cheryl Asplund, Bob DeVries, Ed Theisen and Ann Wallenstedt. Committee discussion started with Chapter III. The following additional changes to Chapter III were discussed and are recommended for further consideration by the full Commission. Chapter III Procedure of Council Section 3.01 (1) "The Mayor or any two members of the Council may call special 71 8) meetings of the Council upon at least twenty -four hours written notice to each member of the Council, except that a meeting dealing with passage of an emergency ordinance may be called with at least twelve hours written notice to each member of the Council." (2) Change the last sentance to read: "All meetings of the Council shall be public in accordance with the State Open Meeting Laws, and any records thereof shall be made available at all reasonable times." Note: We recommend that this changes specific language be drafted by the City Attorney. Section 3.02 This paragraph designates the City Clerk as Secretary of the Council and we recommend that it remain this way. However, reference is drawn to Section 6.04 (page 13), lines 9 and 10 which state: "The Clerk may be designated by the City Manager to act as Secretary of the Council." We recommend deletion of this line to eliminate the conflict with Section 3.02 which this committee feels should dominate. Section :3 -03 The committee recommends that lines 2, 3, 4 and 5 be rewritten as follows: "A majority of all members shall constitute a quorum to do business, but a smaller number may adjourn from time to time and may compel the attendance of absent members as prescribed by ordinance. The Council shall by ordinance provide a means by which a minority may compel the attendance of absent members." Note: The committee had some trouble understanding the intent as currently written. However, the additional verbage helps clarify and was in a model charter and is passed on as a change for full Commission comment and consideration. Section 3.04 (1) One small housekeeping adjustment is proposed for line 3: "The aye and no votes, and abstentions, on ordinances, resolutions and motions shall be recorded." (2) No change is recommended on the "majority rule" requirement. Section 3.05 The last two lines need a housekeeping adjustment: "Every ordinance, other than an emergency ordinance, shall be published in the official newspaper at least one week prior to the final passage." Sections 3.06 and 3.07 No change is recommended. Section 3.08 The committee recommends that the last two lines be changed to read: "Every ordinance shall be published at least once in the official newspaper within 30 days of its final passage." Sections 3.09, 3.10 and 3.11 No change is recommended. Chapter IV Nominations and Elections Page 2 Section 4.01 No change is recommended. Section 4.02 The committee recommends that the number of nominations per elective office be changed as follows: "0n Tuesday, at least six (6) weeks in advance of the regular munici- pal election, there shall be a primary election for the selection of four nominees for each elected office at the regular municipal election unless no more than four nominees file for each elective office. Then two vacancies exist on the Council and the number of candidates is more than eight, the eight candidates receiving the highest number of votes shall be the nominees for the offices named." Section 4.03 The committee recommends lines 2 and 3 be changed to read: "At least three (3) weeks of weekly published notice of a special election shall be given in the official newspaper."
