HomeMy WebLinkAbout1972-166 CCR1 1 Member John Leary and moved its adoption: RESOLUTION NO. 72 -166 introduced the following resolution RESOLUTION CONFIRMING ASSESSMENTS FOR WATER MAIN IMPROVEMENT NO'S. 1971 -14, 1971 -17, 1971 -18, AND 1971 -22; AND SANITARY SEWER IMPROVEMENT NO'S. 1971 -13, 1971 -16 AND 1971 -20; AND STREET SURFACING IMPROVEMENT NO. 1971 -2; AND STREET RESTORATION NO. 1971 -19; AND STREET BASE AND SURFACING IMPROVEMENT NO'S. 1970 -20 AND 1971 -4; AND STREET BASE, SURFACING AND SIDEWALK IMPROVEMENT NO'S. 1970 -19 AND 1971 -8; AND STREET GRADING, BASE AND SURFACING IMPROVEMENT NO'S. 1970 -13, 1970 -15 AND 1971 -5; AND CURB AND GUTTER IMPROVEMENT NO'S. 1969 -38, 1969 -52, 1969 -57, 1970 -14, 1970 -16 AND 1971 -6; AND CURB, GUTTER AND SIDEWALK IMPROVEMENT NO'S. 1971 -7; AND STORM SEWER IMPROVEMENT NO. 1971 -21; AND PUBLIC UTILITIES WATER HOOKUPS; AND PUBLIC UTILITIES WATER REVENUE 72; AND SEWER CONNECTIONS. BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota as follows: 1. The City Clerk has, with the assistance of the Engineer heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the improvements known as the improvements listed above of said City against every assessable lot, piece or parcel of land in accordance with the pro- visions of law, and has prepared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in regular session on Monday, September 25, 1972, to pass on the proposed assessments. 3. Said proposed assessments have at all times been open to inspection and copying by all persons interested, and opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments, or to any item thereof. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessments was and is specially benefitted by said improvement in the amount of said pro- posed assessment set opposite the description of each lot, piece or parcel of land, and that amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described. 5. Such proposed assessments are adopted and confirmed, and the sums fixed and named in said proposed assessments are affirmed, adopted and confirmed as the proper special assessments for each of said lots, pieces or parcels of land respectively. 1 1 1 RESOLUTION NO. 72 -166 6. Said assessments as adopted and confirmed shall be certified to by the City Clerk and filed in his office, and shall thereon be and constitute the special assessments for the payment of the above listed improvements. 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of seven and one -half per cent (7.5%) per annum. 8. Such assessments shall be payable in equal installments beginning in the year 1972 payable on the 16th day of November in each succeeding year and continuing until all of said installments shall have been paid, each installment to be collected with the taxes collectible during said year by the County Auditor. Street Surfacing Improvement No. 1971 -2 in seven equal installments. H. Street Restoration Improvement No. 1971 -19 in seven equal installments. I. Street Base and Surfacing Improvement No's. 1970 -20 and 1971 -4 in fifteen equal installments. J. Street Base, Surfacing and Sidewalk Improvement No's. 1970 -19 and 1971 -8 in fifteen equal installments. K. Street Grading, Base and Surfacing Improvement No's,. 1970 -13, 1970 -15 and 1971 -5 in fifteen equal installments. L. September 25, 1972 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Vernon Ausen, Howard Heck and Maurice Britts; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
