RESOLUTION NO. 72 -203
introduced the following
RESOLUTION AMENDING THE SCHEDULE OF RATES AND FEES FOR
THE USE OF AND CONNECTION TO THE SANITARY SEWER SYSTEM
OF THE CITY OF BROOKLYN CENTER
WHEREAS, a municipal Public Utilities Department exists for
the purpose of providing and maintaining water and sanitary sewer
facilities for the citizens of the City of Brooklyn Center; and
WHEREAS, it is a requirement of the City Charter that the
Public Utilities Department be a self sustaining entity through revenue
provided by a uniform schedule of rates and fees; and
WHEREAS, the Metropolitan Sewer Board assumed ownership and
operation of all existing interceptors and treatment works needed to
implement the Metropolitan Council's Comprehensive Plan for collection,
treatment and disposal of sewage in the metropolitan area, pursuant to
the Metropolitan Sewer Act, Chapter 449, 1969 Session Laws, State of
Minnesota; and
WHEREAS, upon incurring a substantial increase in Metropolitan
Sewer Board sewage charges, the City Council of the City of Brooklyn
Center after a public hearing did by Resolution No. 71 -10, adopted
January 18, 1971, amend the schedule of rates and fees for the use of
and connection to the sanitary sewer system by increasing the residential
customer quarterly rate from $3.75 to $8.75, but did not increase the
connection fee of $10.00 per connection; and
WHEREAS, although the City opposed and initiated court action
against the policy, the Metropolitan Sewer Board and the Metropolitan
Council did on October 12, 1972, adopt a new cost allocation system
whereby a Service Availability Charge will replace the previously
billed Reserve Capacity and Deferment Charges; and
WHEREAS, the City of Brooklyn Center's estimated share for
1973 by the new Service Availability Charge system is 2.5 times greater
than the currently billed Reserve Capacity and Deferment Charges; and
WHEREAS, the Metropolitan Sewer Board will charge local muni-
cipalities in accordance with the number of new service connection or
building permit unit equivalents times a Service Availability Charge,
and suggests that local municipalities require new service users to
pay such Service Availability Charges; and
WHEREAS, consistent with Chapter 11 of the Brooklyn Center City
Charter, the City Council on December 18, 1972, conducted a public hear
ing at which an opportunity was afforded all interested citizens to be
heard;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center that the schedule of sanitary sewer rates and fees
be adopted in amended form as follows:

The number of unit equivalents which are connected or for which a
building permit is issued shall be computed in accordance with the
guidelines set forth by the Metropolitan Sewer Board on file in the
office of the City Engineer. A summary of the guidelines is as
follows:
a. Single family, double bungalows,
duplexes and town houses
b. Apartments and condominiums
c. Non residential
d. Public and Federal subsidized low and
moderate income housing
e. Units existing with on -site disposal systems,
or for which building permits were issued
prior to January 1, 1973, if connected to
sanitary sewer system during 1973

BE IT FURTHER RESOLVED that the above amended schedule of
sanitary sewer rates and fees becomes effective on January 1, 1973.

The motion for the adoption of the foregoing resolution was duly
seconded by member John Leary and upon vote being taken thereon,
the following voted in` favor thereof: Philip Cohen, John Leary,
Howard Heck, Vernon Ausen, and Maurice Britts;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
