HomeMy WebLinkAbout1973-038 CCR1 1 1 Member Maurice Britts introduced the following resolution and moved its adoption: RESOLUTION NO. 73 -38 RESOLUTION SUPPORTING PROVISIONS OF SENATE FILE 533 REGARDING MONETARY CEILING UNDER THE LIQUOR CIVIL DAMAGE ACT WHEREAS, the City of Brooklyn Center is engaged in a municipal liquor operation; and WHEREAS, as such the City of Brooklyn Center is subject to the provisions of the liquor civil damage act known as the dram shop law; and WHEREAS, the provisions of the dram shop law are exceedingly harsh in terms of burden of proof and in terms of monetary liability exposure: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center as follows: Date 1. The City Council supports the provisions of Senate File 533 or similar legislation which would place a reasonable monetary ceiling on liability under the liquor civil damage act and which would also require the liquor dispenser to carry liquor liability insurance at least to the extent of the monetary limitation. 2. The legislative representatives of the people of Brooklyn Center are herewith called upon to support adoption of this or similar legislation and the City Clerk is hereby directed to transmit copies of this resolution to the aforementioned legislators, to the chairman of the appropriate legislative committees, and to the governor of the State of Minnesota. March 12, 1973 The motion for the adoption of the foregoing resolution was duly seconded by member Tony Kuefler, and upon vote being taken thereon the following voted in favor thereof: Philip Cohen, John Leary, Maurice Britts, Tony Kuefler, and Bill Fignar; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
