Member Bill Fignar introduced the following resolution and
moved its adoption:
RESOLUTION NO. 73 -118
RESOLUTION DENYING PLANNING COMMISSION APPLICATION NO. 73014
WHEREAS, Planning Commission Application No. 73014 was submitted by
Mork Associates on May 9, 1973 requesting approval of site and building
plans; and
WHEREAS, administrative review indicated certain Zoning Ordinance and
Building Code deficiencies; and
WHEREAS, the applicant was informed with no success that said deficiencies
should be remedied prior to review by the Planning Commission; and
WHEREAS, at the applicant's insistence the item was placed on the
June 7, 1973 Planning Commission agenda, despite the failure of the applicant
to comply with ordinance and code requirements; and
WHEREAS, the Planning Commission recommended denial of Application
No. 73014 following extensive deliberation and the applicant's request that
the matter be forwarded to the City Council for disposition; and
WHEREAS, the City Council at the July 9, 1973 regular meeting reviewed
the plans received from the Planning Commission; noted the Commission's
deliberation and recommendation; and heard testimony from interested citizens;
and
WHEREAS, extensive discussion ensued by the Council following comments
by the applicant and the Administration;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that Planning Commission Application No. 73014 submitted by
Mork Associates be denied, noting the submitted plans:
1. Are deficient as to land area requirements of Chapter 35 of the
City Ordinances;
2. Are deficient as to parking requirements of Chapter 35 of the
City Ordinances;
3. Are deficient as to approved security system requirement of
Chapter 35 of the City Ordinances;
4. Are deficient as to extension of fire separation walls a minimum 30"
above roof line as required by U. B. C. Chapter 5.

The motion for the adoption of the foregoing resolution was duly seconded by
member John Leary and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary, Maurice Britts,
Bill Fignar, and Tony Kuefler;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
