and moved its adoption:
RESOLUTION NO. 72 -33
RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO
EXECUTE A STREET LIGHTING CONTRACT WITH THE NORTHERN
STATES POWER COMPANY
WHEREAS, the Northern States Power Company is offering to
the City of Brooklyn Center a new street lighting contract to be
in effect for a period of five years, effective April 1, 1972; and
WHEREAS, certain discussions have been held regarding the
formation of a metropolitan or state -wide agency having the regu-
latory authority for establishing equitable utility rate schedules;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center, Minnesota, as follows:
1. That the proposal of the Northern States Power Company,
a Minnesota corporation, to furnish street lighting
service with all lights located or to be located in
the said City, is hereby accepted subject to the
following qualifications:
a) That in the event of the formation of a metropol-
itan or state -wide utility regulating agency
having the authority to review and approve electric
rates, the rates embodied in this contract shall
be subject to the review and approval of said
regulatory agency.
b) That underground street lighting service with
wood poles shall be extended within the Brooklyn
Center Industrial Park upon request by the City.
2. That all rates, terms, conditions, and specifications
in the street lighting contract made a part of the
proposal of said company are hereby approved subject
to the above qualifications.
3. That the Mayor and City Manager are hereby authorized
and directed to execute the aforesaid contract subject
to the above qualifications for and in the name of the
City, and to affix the corporate seal thereto.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck, and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Vernon Ausen, and Howard Heck;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
