HomeMy WebLinkAbout1972-063 CCR Member john Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 72 -63 RESOLUTION SUPPORTING SEWER SERVICE AREA NO. 1 ADVISORY BOARD ACTION RELATIVE TO METROPOLITAN SEWER BENEFITS WHEREAS, the Metropolitan Sewer Act (Chapter 449, 1969 laws) charged the Metropolitan Council with, among other responsibilities, that of allocating the cost associated with the expansion, improvement, and operation of the metropolitan sewer system among the using muni- cipalities; and WHEREAS, the said act provides that: "Subd. 5. ALLOCATION OF METROPOLITAN INTERCEPTOR COSTS; ASSESSED VALUE AND POPULATION. When the council determines that a particular interceptor or some part thereof is of substantial benefit to the metropolitan area as a whole, each year the board shall deduct all of the current costs thereof allocable to such benefit from the current costs to be allocated under subdivision 4. The total amount so deducted shall be allocated among and paid by all local government units in the metropolitan area which will discharge sewage, directly or indirectly, into the metro- politan disposal system in the next budget year, as follows: (a) one -half in the proportion that the assessed value of all taxable property within each such local government unit in the metropolitan area bears to the assessed value of the taxable property in all such local government units, as last finally equalized before October 1 in the year in which the budget is adopted; and (b) one -half in the pro- portion that the population of each such local government unit in the metropolitan area bears to the total population in all such local government units, as estimated by the council from the most recent data available to it." WHEREAS, the said act does not further define "substantial benefit to the metropolitan area and does not provide the criteria for making the determination; and WHEREAS, such a determination may significantly affect sewer service charges to municipalities of the metropolitan area; and WHEREAS, the Metropolitan Council's development guide committee is currently considering alternative policies for deter mining metropolitan sewer benefits; and WHEREAS, the Sewer Service Area No, 1 Advisory Board has considered in detail the said alternative policies; and RESOLUTION NO. 72 -63 WHEREAS, the said Advisory Board did on April 13, 1972 take the action recommending to the Metropolitan Council the following: 1) That Alternative A with certain modifications be adopted as the best and most equitable policy for determining metropolitan benefits as indicated in the Metropolitan Sewer Act. 2) That method No. 2 be adopted for computing the cost of metropolitan benefits. and WHEREAS, the City of Brooklyn Center is apprehensive regarding the definition and application of the metropolitan benefit concept, but recognizes that some form of metropolitan benefit will perhaps be adopted by the Metropolitan Council; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center that the City Council does support the action taken by the Sewer Service Area No. 1 Advisory Board relative to recommending to the Metropolitan Council the following: 1) That Alternative A with certain modifications be adopted as the best and most equitable policy for determining metropolitan benefits as indicated in the Metropolitan Sewer Act. 2) That Method No. 2 be adopted for computing the cost of metropolitan benefits. May 8, 1972 Date Mayor ATTEST: Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Vernon Ausen, Howard Heck and Maurice Britts; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
