HomeMy WebLinkAbout1972-133 CCR I Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 72 -133 RESOLUTION ESTABLISHING SPECIAL ELECTION TO AUTHORIZE ISSUANCE OF SPECIAL "ON- SALE" LIQUOR LICENSES TO SELL INTOXICATING LIQUOR ON SUNDAYS WHEREAS, citizens and elected officials of Brooklyn Center have recognized the advantages of attracting quality dining and lodging facilities into Brooklyn Center for numerous reasons, among them the development of a balanced tax base, the supply of needed services, additional jobs, and the ability of such facilities to generate and encourage peripheral industrial and commercial development; and WHEREAS, during the decade of the 1960's, Brooklyn Center was a leader in advocating and securing legislative authority to issue "on- sale" liquor licenses to private persons for hotel, restaurant and club establish- ments while maintaining the advantages of the municipal "off- sale" operation; and WHEREAS, on July 15, 1969, the electorate of Brooklyn Center authorized the issuance of such "on- sale" liquor licenses to private persons; and WHEREAS, the authority granted by the electorate has subsequently been implemented by the issuance of certain "on- sale" liquor licenses; and WHEREAS, testimony has been presented and it is the observation and determination of the City Council that the inability of licensed restaurants, hotels and clubs to sell intoxicating liquor on Sundays serves as a detriment to fully realizing the advantages of a liquor license; and WHEREAS, Minnesota Statutes 340.14, subdivision 5 authorize the City Council to issue special licenses for the sale of intoxicating liquors on Sundays between the hours of 12 :00 O'clock Noon and 12 :00 O'clock Midnight, provided, that the issuance of such special licenses are authorized by the voters of Brooklyn Center: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota to hereby establish a special election to be con- ducted in conjunction with the primary election on September 12, 1972 for the purpose of submitting to the voters of the City the following question: "SHALL SPECIAL LICENSES BE GRANTED FOR THE SALE OF INTOXICATING LIQUOR BETWEEN THE HOURS OF 12 :00 O'CLOCK NOON AND MIDNIGHT ON SUNDAYS AT HOTELS, RESTAURANTS AND CLUBS IN THE CITY OF BROOKLYN CENTER Resolution No. 72 -133 BE IT FURTHER RESOLVED that said special election shall be subject to the same general procedures and regulations prescribed by Chapter 29 of the City Ordinances, by the City Charter, and by appropriate State laws.
