and moved its adoption:
RESOLUTION NO. 71 -130
RESOLUTION APPROVING PLANNING COMMISSION APPLICATION NO. 70012
WHEREAS, Viewcon Inc., has requested site and building plan
approval for a 102 unit townhouse development to be located on Lot 2
Block 1 Twin Lakes North Addition;and
WHEREAS, the Planning Commission considered a similar proposal
for the property consisting of 96 townhouse units on April 2, 1970
and upon review of same recommended conceptual approval of the plans;
and
WHEREAS, the City Council viewed the proposal on April 13, 1970
and approved the site and building plan concept for 96 townhouse
units and further directed the City Manager to develop and recommend
methods of resolving inconsistencies and conflicts between the
subject proposal and existing ordinance structure; and
WHEREAS, on May 24, 1971 the applicant presented a modified
proposal to the City Council requesting approval of a 102 unit
townhouse development which was reprimanded to the Planning
Commission for there review and recommendation; and
WHEREAS, on June 4, 1971 the Planning Commission reviewed the
modified proposal and recommended approval to the City Council; and
WHEREAS, the City Council reviewed the matter on June 14, 1971 and
directed that a resolution be drafted approving the subject application;
and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota to approve Planning Commission Application
No. 70012 subject to the following qualifications and conditions:
1. That a model four unit cluster be allowed to
commence prior to the construction of the
remaining 40 units in Phase 1 of the development.
2. That the Master Plan be approved with the provision
that the balance of Phase 1 and Phase 11 be reviewed
by the Planning Commission and Council upon completion
of the four unit model cluster to determine if there
are any necessary adjustments to the total develop
ment plan prior to entering into Phase laand Phase 11.

3. That additional berms beyond those indicated on
the site plans be provided adjacent to single family
residence along June Avenue and further that such
berms be constructed as early as possible and that
such work be prosecuted in a reasonably continuous
fashion subject to the influences and constrains
of accepted construction practices.
4. That a snow fence or other effective device be erected on
the east property line and maintained during the construction of
the berms and subsequent thereto that such device
be relocated on the westerly side of such berms
to contain construction debris on the site and to
inhibit children's access to the site.
5. That utility drainage and elevation plans are
subject to the approval of the City Engineer prior
to the issuance of a building permit.
6. That the Homeowners Association agreement is consistent
with State and /or local laws governing such agree-
ments and subject to the approval of the City.. Council.
7. That the building plans are subject to the approval
of the Building Inspector with respect to applicable
Building codes.
8. That a performance agreement and performance bond
in an amount to be determined by the City Manager
be submitted to the City to guarantee the site
improvements as designated on the plans submitted.
9. That the platting requirement be waived because of
the unique, characteristics of condominium
development until such time as a iven Phase of the
development is completed.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck 11 and upon vote being taken thereon,
the following voted in favor thereof: Philip Cohen, John Leary,
Vernon Ausen, Howard Heck and 'Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
