and moved its adoption:
RESOLUTION N0, 71 -158
RESOLUTION ACCEPTING WORK
(CONTRACTED BY CITY)
WHEREAS, pursuant to a written contract signed with the
City of Brooklyn Center, Minnesota,Erwin Montgomery Construction Co.
has satisfactorily completed the following improvement in accord-
ance with said contract:
Water Main Improvement Project No. 1970 -8 (Contract 1970 -B)
James Avenue No. from 65th Ave. to 67th Ave., and 67th
Avenue No. from James Ave. to approx. 220 ft. east of James.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved.
2. The value of work performed is less than the original
contract amount by $312.30 because one service stub was eliminated,
thereby reducing the total amount of 8" C.I.P, and eliminating one
8 gate valve.
3. It is hereby confirmed that final payment has been satis-
fied on said contract on August 9, 1971, taking the contractor's
receipt in full. The total amount paid for said contract for said
improvement project was $11,759.40.

The motion for the adoption of the foregoing resolution was duly
seconded by member Vernon Ausen, and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary and Vernon Ausen;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
