and moved its adoption:
RESOLUTION NO. 71 -182
RESOLUTION APPROVING TRUNK HIGHWAY 152 BRIDGE PLANS AT THE
SOO LINE RAILROAD NEAR 49TH AVENUE NORTH
WHEREAS, the Commissioner of Highways has prepared plans,
special provisions and specifications for the improvement of a part
of T.H. No. 129 (renumbered as T.H. No. 152) within the corporate
limits of the City of Brooklyn Center at the Soo Line Railroad near
49th Avenue North; and
WHEREAS, said plans are on file in the office of the Depart-
ment of Highways, Saint Paul, Minnesota, being marked, labeled, and
identified as S.P. 2741 -27152 (152 =129); and
WHEREAS, said special provisions are on file in the office of
the Department of Highways, Saint Paul, Minnesota, being marked,
labeled and identified as S.P. 2741 -27152 (152 =129), which, together
with the Minnesota Department of Highways Specifications for Highway
Construction, dated January 1, 1968, as amended by Supplemental
Specifications, dated July 1, 1969, on file in the office of the
Commissioner of Highways, constitute the specifications for said
improvement of T.H. No. 129 (renumbered as T.H. No. 152); and
WHEREAS, copies of said plans and special provisions as so
marked, labeled and identified are also on file in the office of the
City Clerk; and
WHEREAS, the term "said plans and special provisions" as here-
inafter used in the body of this resolution shall be deemed and
intended to mean, refer to, and incorporate the plans and special
provisions in the foregoing recitals particularly identified and
described; and
WHEREAS, the said plans and special provisions do not provide
for protective screening on the sides of the bridge; and
WHEREAS, the City Council of the City of Brooklyn Center deems
it necessary for the health and general welfare of its pedestrians to
provide protective screening on said bridge.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center, Minnesota, as follows:
1. That the said plans and special provisions providing for
the improvement of T.H. No. 129 (renumbered as T.H. No. 152)
within the limits of the City of Brooklyn Center be amended
to include protective screening on both sides of said bridge.
