and moved its adoption:
RESOLUTION NO. 71 -183
RESOLUTION CONTROLLING PARKING AND AGREEING NOT TO PERMIT
ENCROACHMENT UPON THE RIGHT -OF -WAY OF T.H. NO. 152
WHEREAS, the City of Brooklyn Center has approved the plans
and specifications for the improvement of that part of T.H. No. 129
(renumbered as T.H. No. 152) within the corporate limits of the City
of Brooklyn Center at the Soo Line Railroad near 49th Avenue North;
and
WHEREAS, in order to obtain Federal Aid in the construction
of said T.H. No. 129 (renumbered as T.H. No. 152) the Federal Highway
Administration requires the assurance that the City of Brooklyn Center
will not suffer any encroachment of any nature or kind whatsoever on
the right -of -way of said T.H. No. 129 (renumbered as T.H. No. 152)
within the corporate limits of the said City of Brooklyn Center; and
WHEREAS, the Commissioner of Highways desires in the interest
of public safety that all parking vehicles on said trunk highway be
parallel with the curb and at least 20 feet from any crosswalk.
NOW, THEREFORE, BE IT RESOLVED that said City of Brooklyn Center
does hereby agree and covenant that it will never permit or suffer,
within its corporate limits, any encroachment of any kind whatsoever,
including curb gas pumps and gas stations, billboards or other struc-
tures of any kind whatsoever, upon the right -of -way of T.H. 129 (re-
numbered as T.H. No. 152) and to the above end said City of Brooklyn
Center hereby agrees that it will never issue any license, permit, or
grant, or give any leave or liberty or any other consent of whatever
form for the construction or maintenance of any encroachment whatso-
ever, including curb gas pumps and gas stations, billboards or other
structures of any kind whatsoever, upon said right -of -way; and that
said City of Brooklyn Center will cooperate insofar as possible to
eliminate existing encroachments constituting traffic hazards and
will further take any necessary action to eliminate any encroachment
that may hereafter exist on said trunk highway right -of -way; and
BE IT FURTHER RESOLVED that said City of Brooklyn Center does
hereby agree to require the parking of all vehicles on said trunk
highway to be parallel with the curb and at least twenty (20) feet
from any crosswalks on all public streets intersecting said trunk
highway within the corporate limits of said City of Brooklyn Center.
