HomeMy WebLinkAbout1971-192 CCR Member Theodore Willard introduced the following resolution and moved its adoption: RESOLUTION NO. 71 -192 RESOLUTION RELATIVE TO SUBDIVISION BOND FOR THOMAS CONSTRUCTION CO. 2ND ADDITION PERTAINING TO LOTS 3, 4 5 OF BLOCK 2 WHEREAS, on December 16, 1969 a certified check in the amount of $3,000.00 was posted to guarantee certain subdivision improvements in the Thomas Construction Co. 2nd Addition; and WHEREAS, on October 1, 1971 an agreement dated September 21, 1971 was received which assigned the above subdivision obligations to David Baerg; and WHEREAS, a certified check in the amount of $3,000.00 was received with the above mentioned agreement, which check was deposited in the Investment Trust Fund of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center as follows: 1. To accept a $3,000.00 cash escrow from David Baerg to guarantee the improvements for the Thomas Construction Co. 2nd Addition as set forth in the Financial Performance Guarantee by Developer or Contractor dated September 21, 1971. 2. To direct the City Treasurer to return to the Thomas Construction Company the presently held cash escrow in the amount of $3,000.00. October 5, 1971 Date Mayor ATTEST: 11 0 Cler The motion for the adoption of the foregoing resolution was duly seconded by member John Leary and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Vernon Ausen, Howard Heck and Theodore Willard; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
