HomeMy WebLinkAbout1971-087 CCR Member Theodore Will ardintroduce d the following resolution and moved its adoption: RESOLUTION NO. 71 -87 RESOLUTION DENYING PLANNING COMMISSION APPLICATION NO. 70060 WHEREAS, Ernst, Lane Ernst, Inc. has requested rezoning of Lots 4 and 5, Lane's Brooklyn Center Addition, from R -1 to C -2 (commercial); and WHEREAS, the City Council considered such proposal on February 8, 1971 and April 5, 1971; and WHEREAS, the proposed zoning is inconsistent with the goals of the Comprehensive Plan because: 1. The proposed zoning will tend to adversely contribute to traffic conditions on Brooklyn Boulevard which are incon- sistent with its function as an arterial highway moving heavy traffic; 2. The proposed zoning promotes the further development of intensely active commercial facilities fronting on Brooklyn Boulevard and having direct access to Brooklyn Boulevard; 3. The proposed zoning does not encourage the development of service /office uses and multiple family dwellings along Brooklyn Boulevard, but rather to encourage further development of more intensive commercial uses; and WHEREAS, planning and zoning principles of providing an appro- priate buffer between intensive C -2 commercial uses and residential land uses cannot be provided; and WHEREAS, intensive commercial encroachment on June Avenue would deprive adjoining property owners of the full use and enjoyment of their property for single family dwelling uses; and WHEREAS, since the taking of adjoining property some years ago for highway improvement, the character of the subject property has changed from an intensive C -2 use to one of a less intense use, thus becoming more compatible with adjoining residential uses: RESOLUTION NO. 71-87 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota, to deny Planning Commission Application No. 70060 because it is inconsistent with the goals of the Comprehensive Plan, inconsistent with planning and zoning principles, and would serve as a detriment to the safety, health and welfare of property owners in the immediate vicinity.
