and moved its adoption:
RESOLUTION NO. 71 -91
RESOLUTION REGARDING A GREEN STRIP ENCROACHMENT AT
BROOKDALE FORD CAUSED BY THE WIDENING OF COUNTY
ROAD 10
WHEREAS, the City of Brooklyn Center and Hennepin County
have entered into an agreement to construct turn lanes on the
westbound lane of County Road 10 easterly of Shingle Creek Parkway;
and
WHEREAS, a portion of the proposed right turn lane over-
lies the southerly 2 feet of the westerly 300 feet of Tract A,
R.L.S. 1256, commonly known as Brookdale Ford; and
WHEREAS, Hennepin County is currently negotiating for a
highway easement overlying the southerly 5 feet of said parcel, and
WHEREAS, the City of Brooklyn Center Ordinance Section
35 -412 states that: "No parking shall be permitted within 15 feet
of the street right -of -way and this 15 -foot area shall be main-
tained as a green strip."
NOW, THEREFORE, BE IT RESOLVED that the City Council
recognizes that the northerly 2 feet of the proposed right turn
lane on County Road 10 easterly of Shingle Creek Parkway overlies
Brookdale Ford property and that it is not intended, now or in the
future, that such roadway intrusion into the green strip area will
serve to require Brookdale Ford to provide replacement green strip
area.

The motion for the adoption of the foregoing resolution was duly
seconded by member T. Willard and upon vote being taken thereon
the following voted in favor thereof: Philip Cohen, John Leary,
Vernon Ausen, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
