RESOLUTION NO.
RESOLUTION OPPOSING THE ADOPTION OF SENATE FILE 2020
VESTING THE STATE BOARD OF HEALTH WITH EXCLUSIVE
JURISDICTION OVER NURSING HOMES
WHEREAS, Minnesota Statutes provide that the State Board of
Health, in a manner prescribed by law, adopt and enforce reasonable
rules, regulations, and standards regarding nursing homes and boarding
care homes; and
WHEREAS, the Statutes further provide that in the public
interest, the Board, by such rules, regulations and standards,
may regulate and establish minimum standards as to the construction,
equipment, maintenance and operation of the institutions inasfar
as they relate to sanitation and safety of the buildings and to the
health, treatment, comfort, safety, and well being of the persons
accommodated for care; and
WHEREAS, minimum standards are not necessarily the most
desirable universally for the resident patients of nursing homes
and. boarding care homes, or for the municipalities wherein such
institutions are constructed; and
WHEREAS, the City Council of the City of Brooklyn Center deems
it necessary to the welfare of the community that nursing homes and
boarding care homes be regulated and licensed locally to promote
the highest levels of environment, health care, and safety, and to
preserve the dignity of resident patients thereof; and
WHEREAS, the intent of any local ordinance concerning the
regulations and license of nursing homes and boarding care homes
would be to supplement Minnesota Regulations for nursing care homes
and boarding care homes; and
WHEREAS, Brooklyn Center's ordinance specifies that when any
provision therein is either more stringent or less stringent then
similar provisions of Minnesota Law or Minnesota Agency regulations,
which would be adopted therein by reference, the more stringent
provisions would prevail;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BROOKLYN CENTER AS FOLLOWS:
1. The City Council does not endorse and discourages support
of Senate File 2020 which, if adopted, would establish the
jurisdiction for the promulgation of rules, regulations
and standards pertaining to nursing homes exclusively with
Resolution No. 71 -95
the State Board of Health with concomitant consequences
of infrequent inspections and minimal standards;
2. The representatives of the people of Brooklyn Center
are herewith called upon to support and work for the
termination of this legislation and the Clerk is
hereby directed to transmit copies of this resolution
to the aforementioned representatives, the Chairman of
the appropriate legislative committee, and to the
Governor of the State of Minnesota

The motion for the adoption of the foregoing resolution was duly
seconded by member Vernon Ausen and upon vote being
taken thereon, the following voted in favor thereof: Philip Cohen
John Leary, Vernon Ausen, Howard Heck and Theodore Willard;
and the following voted against the same; none,
whereupon said resolution was declared duly passed and adopted.
