and moved its adoption:
RESOLUTION NO. 71-120
RESOLUTION DENYING PLANNING COMMISSION APPLICATION
NO. 70048
WHEREAS, Viewcon, Inc. has requested rezoning of a property located
at the northwest quadrant of 58th and Major Avenues North from R -5 to C -2
Commercial; and
WHEREAS, 58th Avenue North is a major traffic artery and the proposed
rezoning is inconsistent with its function as a major thoroughfare moving heavy
traffic; and
WHEREAS, the Comprehensive Plan and existing Zoning Ordinance do
not allow commercial uses in residential districts; and
WHEREAS, approval of the application would establish an undesirable precedent
throughout the community in view of existing ordinance requirements which separate
commercial and residential uses; and
WHEREAS, it is ascertained that granting approval of the application
would encourage strip commercial development of similar vacant parcels located'
in the vicinity of 58th Ave.. \brth west of Brooklyn Boulevard and at other locations
throughout the City; and
WHEREAS, the subject property is extremely isolated from other
commercial developments; and
WHEREAS, the City Council recognizes a potential need and desire for
convenience center facilities within the community and does intend. to _examine
the extent of such need and the standards governing the location and placement of
convenience centers:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota to deny Planning Commission Application No. 70048
because the present Comprehensive Plan and Zoning Ordinance do not adequately
provide for the neighborhood convenience center concept and it would not serve in
the best interests of the health, safety and welfare of the mmunity.

The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, john Leary Vernon Ausen,
Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
