HomeMy WebLinkAbout1971-064 CCR Member Vernon Ausen introduced the following resolution and moved its adoption: RESOLUTION NO. 71 -64 RESOLUTION APPROPRIATING UNALLOCATED STATE AID CONSTRUCTION FUNDS FOR THE INSTALLATION OF SIGNAL DEVICES AT THE INTER- SECTION OF THE SOO LINE RAILROAD AND FRANCE AVENUE NORTH IN BROOKLYN CENTER WHEREAS, the City Council of the City of Brooklyn Center did by Resolution No. 68 -129 adopted June 3, 1968 petition the Public Service Commission of the State of Minnesota for a full investigation of the Soo Line Railroad intersection with France Avenue leading to the installation of crossing signal devices as may be deemed necessary for the protection of the general public, and that a fair and equitable division of costs be determined between the Soo Line Railroad Company and the public authorities; and WHEREAS, a public hearing was held by the Public Service Commission of the State of Minnesota relative to the above installation in the Council chambers of Brooklyn Center, Minnesota, pursuant to due notice given on Friday, July 12, 1968, at 10:00 o'clock A.M.; and WHEREAS, on July 22, 1968, the Public Service Commission of the State of Minnesota did order the Soo Line Railroad Company to.in- stall within one year of the date of order and in accordance with plans to be approved by the Minnesota Public Service Commission, Minnesota standard automatic electric highway railroad grade crossing signals at the crossing of France Avenue North, with its right -of -way and tracks in the City of Brooklyn Center, Minnesota; and WHEREAS, the said order stipulated, among other things, that the City of Brooklyn Center should pay to the Soo Line Railroad Company 25% of the actual cost of installation, but not to exceed $6,398.00; and WHEREAS, the subject signal installation has been completed by the Soo Line Railroad Company on a force account basis using Soo Line Railroad Company employees at a total cost of $21,687.02, and a statement has been presented to the City of Brooklyn Center for payment in the amount of $5,421.76, which cost represents 25% of the total cost; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to appropriate from unallocated State Aid construction funds the sum of $5,421.76 to pay Brooklyn Center's share of the cost of installation of signal devices at the intersec- tion of the Soo Line Railroad and France Avenue North.
