and moved its adoption:
RESOLUTION NO. 71 -73
RESOLUTION DENYING PERMANENT DRIVEWAY ENTRANCE AT
SUPER VALU STORES
WHEREAS, Application No. 69024 for site and building plan approval
of Super Valu Stores, Inc. was approved by the City Council on May 5, 1969,
said site plans showing no driveway entrance off Xerxes Avenue and thus
being consistent with the intended site traffic patterns recommended by
the Planning Commission and concurred in by the City Council; and
WHEREAS, installation of a temporary driveway Entrance off Xerxes
Avenue was authorized by the City Manager on May 8, 1970, said temporary
driveway entrance to serve during the four week period of Grand Opening; and
WHEREAS, on April 29, 1970 Super Valu Stores filed Planning Commission
Application No. 70023, requesting an amendment of said site and building
plans by the installation of a permanent driveway entrance off Xerxes Avenue; and
WHEREAS, on June 16, 1970, the City Council tabled Application
No. 70023 and authorized Super Valu Stores to continue the temporary driveway
entrance until April 1, 1971, to permit the applicant to conduct engineering
studies which would show the effect on the applicant's business of the removal
of the temporary driveway entrance; and
WHEREAS, the projected traffic flow on Xerxes Avenue will eventually
create a volume of traffic conflicts at the temporary driveway entrance
necessitating the installation of traffic controls or the re- routing of traffic; and
WHEREAS, the number of traffic conflicts presently created by the
use of the temporary driveway entrance has not yet reached the volume requiring
the installation of traffic controls or the re- routing of traffic:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota as follows:
1. That Application No. 70023 be denied.
2. That the temporary driveway entrance be allowed to continue
until such time as the City Council determines, upon recommendation
of the Director of Public Works, that the number of traffic conflicts
has reached a volume requiring the installation of traffic controls
or the re- routing of traffic.

The motion for the adoption of the foregoing resolution was duly seconded
by member john Leary, and upon vote being taken thereon, the following
voted in favor thereof: Philip Cohen, john Leary, Vernon Ausen,
Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
