and moved its adoption:
RESOLUTION N0: 70 -191
RESOLUTION DIRECTING THE DISBURSEMENT OF CASH ESCROW
FOR BAERG GARDENS
WHEREAS, on February 28, 1969, the City of Brooklyn Center
received a cash escrow deposit in the amount of $6,000.00 to
guarantee payment of street surfacing in Baerg Gardens Addition, and
WHEREAS, the developer, David Baerg, has also guaranteed
payment of the street surfacing for Lot 6, Block 1, George's Terrace
3rd Addition, and
WHEREAS, the street surfacing as guaranteed by the above
mentioned cash bond was duly installed as part of Project No. 1969 -63
and
WHEREAS, the amount attributable to Baer g Gardens Addition and
Lot 6, Block 1 George's Terrace 3rd Addition for the above mentioned
project is $4,211.51, and
WHEREAS, the amount of improvements remaining to be completed
under said cash escrow is estimated to cost $975.00.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Brooklyn Center direct the City Treasurer to negotiate the
existing cash escrow and credit the proper construction account
a total of $4,211.51
BE IT FURTHER RESOLVED that the City Treasurer retain the
balance of $975.00 until all other work is completed in Baerg
Gardens Addition and issue a check in the amount of $813.49 to David
Baerg, which amount represents the difference to be returned to him
as cash escrow excess.

The motion for the adoption of the foregoing resolution was duly
seconded by member Theodore Willard and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Vernon Ausen, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
