moved its adoption:
RESOLUTION NO. 70 -194
RESOLUTION REGARDING APPLICATION OF NOBLE AVENUE
SIDEWALK COST POLICY TO LOT 13, BLOCK 1, NORTHBROOK
MANOR ADDITION
WHEREAS, on June 1, 1970 the City Council conducted a public hearing
and ordered construction of street grading, base and surfacing and sidewalk on
Noble Avenue from Trunk Highway 152 to the north corporate limits; and
WHEREAS, it was a Council policy deterininatior: that the sidewalk along
Noble Avenue would be financed exclusively by State Aid funds and that no
portion of said sidewalk construction cost would be assessed against abutting
properties; and
WHEREAS, the entire project was planned to be built in conjunction with
a similar project on Noble Avenue from Brooklyn Center's north corporate limits
northward into Brooklyn Park; and
WHEREAS, in the course of its deliberations, the Brooklyn Park City
Council determined not to install sidewalk on the east side of Noble Avenue
from Brooklyn Center's north corporate limits northward to 73rd Avenue; and
WHEREAS, that determination negated the utility of a sidewalk on the
east side of Noble Avenue from Woodbine Lane to the north corporate limits;
and such segment of sidewalk was subsequently not installed; and
WHEREAS, the owner of Lot 13, Block 1, Northbrook Manor Addition
desired that sidewalk be installed along the west line of his property and
expressed concern that a subsequent installation in future years might be
charged against his property as a special assessment:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota that it is the intention of this City Council that a
subsequent initial installation cost for sidewalk along the east side of Noble
Avenue between Woodbine Lane and the north corporate limits shall not be
assessed against Lot 13, Block 1, Northbrook Manor Addition.

The motion for the adoption of the foregoing resolution was duly seconded by
member Theodore Willard and upon vote being taken thereon, the following
voted in favor thereof: Philip Cohen, John Leary, Vernon Ausen, Howard
Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
