HomeMy WebLinkAbout1970-178 CCR Member john Leary Introduced the following resolution and moved its adoption: RESOLUTION NO. 70-178 RESOLUTION DECLARING THOSE CERTAIN BUILDINGS Located at 5450 BRYANT AVENUE NORTH, BROOKLYN CENTER, MINNESOTA, DILAPIDATED BUILDINGS AND ORDERING THEM TO BE REMOVED WHEREAS, Florence E. Havill is the record owner of the property located at 5450 Bryant Avenue North, Brooklyn Center, Minnesota; and WHEREAS, after receipt of numerous complaints, J. R. Murphey, the Building Inspector of the City of Brooklyn Center, inspected the property and submitted his report to the Council, which described the premises as generally abandoned in a dilapidated and extreme state of disrepair; stating that the house is of generally unsightly appearance; is open to trespassers and children playing in the neighborhood, that it violates Section 203 of the Building Code of the City of Brooklyn Center in that the property is not in a safe and sanitary condition, that the doors and windows are broken and is a fire, health and safety hazard: NOW, THEREFORE, BE IT RESOLVED that Florence Havill shall be ordered to raze and remove the wooden structure located at 5450 Bryant Avenue North, Brooklyn Center, Minnesota, on the property legally described as: That Part of Lot 20, lying West of the East 100 feet thereof, Block 3, Bellvue Acres Addition, Plat 89225, Parcel 5100, Hennepin County Minnesota. And that this action is being taken pursuant to Minnesota Statutes Annotated as. 463.15 463.26 on the grounds that said building is a hazardous building within the meaning of that statute; BE IT FURTHER RESOLVED that Florence Havill, her heirs or assigns, must comply with this order within twenty (20) days from the date of service upon her or within twenty (20) days file an answer thereto, otherwise a motion for summary enforcement of this order will be taken by the City of Brooklyn Center in the Hennepin County District Courtr1 page -2- RESOLUTION NO. 70 -178 September 28, 1970 Date Mayor ATTEST: y C -e rk The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, john Leary, Vernon Ausen and Howard Heck; and the following voted against the same: none, Whereupon said resolution was declared duly passed and adopted.
