and moved its adoption:
RESOLUTION N0. 70 -138
RESOLUTION ACCEPTING WORK
(CONTRACTED BY CITY)

WHEREAS, pursuant to a written contract signed with the
City of Brooklyn Center, Minnesota, C. S. McCrossan, Inc.
has satisfactorily completed the following improvement in accord-
ance with said contract:
Grading, Base 6 Surfacing Improvement Project 1969 -48 (Contract 1969 -F)
Ewing Lane from 63rd Avenue to 62nd Avenue, and 62nd Avenue from
Ewing Lane to T.H. 152.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved.
2. The value of work performed is less than the original
contract amount by $2,423.63 because of the following reasons:
a) $555.00 is due to an over estimating in bituminous
levelling course;
b) $650.00 is due to over estimation of driveway paving;
c) $900.00 is due to over- estimation of sodding; and
d) the remaining difference is due to general over- estimating
of plan quantitites.
3. It is hereby confirmed that final payment has been satis-
fied on said contract on August 10, 1970 taking the contractor's
receipt in full. The total amount paid for said contract for said
improvement project was $7,440.95.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck, and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Vernon Ausen, Howard Heck, and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
