moved its adoption:
RESOLUTION NO.70 -170
RESOLUTION TO REQUEST THE HENNEPIN COUNTY AUDITOR TO
CANCEL PENALTIES ON DELINQUENT SPECIAL ASSESSMENTS ON
BROOKLYN CENTER SCHOOL DISTRICT NO. 286 LAND
WHEREAS, Brooklyn Center School District ##286 was notified
by the Hennepin County Auditor on April 21, 1970, that there were
delinquent special assessments against school owned land described
as Plat 89105, Parcel 5700, Auditor's Subdivision No. 310, Lot 46,
in the amount of $44,003.09 for the years 1962 through 1968; and
WHEREAS, the County Auditor has applied penalities in the
amount of $4,400.32, and interest, which at April 21, 1970
amounted to $10,358.12, to the delinquent assessments; and
WHEREAS, the delinquent assessments were those levied by
the City of Brooklyn Center for improvements to land owned by
School District ##286; and
WHEREAS, when the delinquent assessments, interest and
penalties are collected by the County Auditor, they will be
remitted in their entirity to the City of Brooklyn Center; and
WHEREAS, the assessments became delinquent through a series
of events which were not attributable to the school district; and
WHEREAS, it is the determination of the City Council that the
interest should be collected on the delinquent assessments but that
the penalties should be forgiven:
NOW, THEREFORE:, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota as follows:
1. The Auditor of Hennepin County, Minnesota, is hereby
requested to cancel only penalties on Plat 89105, Parcel
5700, Auditors Subdivision No. 310, Lot 46, for the
years 1962 through 1968.
2. The City Clerk is hereby authorized and directed to
transmit a certified copy of this resolution to said
Hennepin County Auditor forthwith.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Vernon Ausen, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
