and moved its adoption:
RESOLUTION NO. 70 -10
RESOLUTION DECLARING THOSE CERTAIN BUILDINGS
LOCATED AT 1101 73RD AVENUE NORTH, BROOKLYN
CENTER, MINNESOTA, DILAPIDATED BUILDINGS AND
ORDERING THEM TO BE REMOVED
WHEREAS, Margaret Carlson is the record owner of the property
located at 1101 73rd Avenue North, Brooklyn Center, Minnesota; and
WHEREAS, the owner, Margaret Carlson, who has been a recipient
of Old Age Assistance, occupied the property until last year when
she moved, leaving the property unoccupied and generally abandoned;
and
WHEREAS, the State of Minnesota has an Old Age Assistance
Lien on said property and the Hennepin County Welfare Department
has attempted to sell the property but has been unsuccessful
because of the run -down condition of the buildings; and
WHEREAS, after receipt of numerous complaints, J. R. Murphey,
the Building Inspector of the City of Brooklyn Center, on the
9th day of January, 1970, inspected the property and submitted
his report to the Council, which described the premises as
generally abandoned in a dilapidated and extreme state of disrepair;
stating that it is of generally unsightly appearance; is open to
tresspassers and children playing in the neighborhood, that it
violates the Building Code of the City of Brooklyn Center in that
the owner has failed to maintain the property in a safe and
sanitary condition, that the doors and windows are broken and
is a fire, health and safety hazard:
NOW, THEREFORE, BE IT RESOLVED that Margaret Carlson shall
be ordered to raze and remove the cement and wooden structure
located at 1101 73rd Avenue North, Brooklyn Center, Minnesota,
on the property legally described as:
That part of Lot 41, Auditor's Subdivision No.
309, lying North of South 485 feet except street,
Hennepin County, Minnesota.
And that this action is being taken pursuant to Minnesota Statutes
Annotated ss. 463.15 463.26 on the grounds that said building
is a hazardous building within the meaning of that statute;

BE IT FURTHER RESOLVED that Margaret Carlson, her heirs or
assigns, must comply with this order within twenty (20) days
from the date of service upon her or within twenty (20) days
file an answer thereto, otherwise a motion for summary enforce-
ment of this order will be taken by the City of Brooklyn Center
in the Hennepin County District Court.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Vernon Ausen, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
