and moved its adoption:
RESOLUTION NO. 70 -16
RESOLUTION APPROVING A PORTION OF CLASSIFICATION LIST 11 644 -C"
WHEREAS, the City Council of the City of Brooklyn Center,
Hennepin County, Minnesota, has received from the County Auditor of
Hennepin County, Minnesota, a list of lands in said City which be-
came the property of the State of Minnesota under the provisions of
law declaring the forfeiture of lands to the State for non payment
of taxes, which said list has been designated as Classification List
11 644 -C" January 14, 1970; and
WHEREAS, each parcel of land described in said list has
heretofore been classified by the Board of Commissioners of Hennepin
County, Minnesota, as non conservation land and the sale thereof has
heretofore been authorized by said Board of Commissioners; and
WHEREAS, said list includes a parcel of land described as
Lot 1, Block 11, Hipp's East Palmer Lake Addition, which parcel has
been continuously owned by the City of Brooklyn Center since Decem-
ber 27, 1962, and has since been devoted to open space use; and
WHEREAS, it is not the intention of the City Council to
approve that portion of Classification List "644 -C" relating to
said parcel;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center, acting pursuant to Minnesota Statutes 1957,
Section 282.01, Subd. 1, that the said classification by said Board
of County Commissioners of each parcel of land described in said
list as non conservation with the exception of Lot 1, Block 11,
Hipp's East Palmer Lake Addition, Plat 89437, Parcel 7950, be and
the same is hereby approved and that the sale of each such parcel
with the exception of Plat 89437, Parcel 7950, be and the same is
hereby approved.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Vernon Ausen, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
