HomeMy WebLinkAbout1970-051 CCR Member Vernon Ausen introduced the following resolution and moved its adoption: RESOLUTION NO. 70 -51 RESOLUTION CORRECTING STREET ASSESSMENT FOR IMPROVEMENT PROJECT NO. 1967 -37 ON PLAT 89010 PARCEL 2810 WHEREAS, the above listed property was assessed 250.0 feet for street surfacing on Improvement Project No. 1967 -37; and WHEREAS, the property owner has paid the 1969 assessment in- stallment of $195.86; and WHEREAS, the property does not abut the paved roadway on Lakeside Avenue except by extended driveway; however, the property does abut the existing end of Azelia Avenue North; and WHEREAS, the property is presently used as a single family residence and is zoned General Industrial (I -2); and WHEREAS, when the property is further developed, further costs will be incurred by the development or by City assessments if the work is done by City forces; and WHEREAS, the property does not benefit from the full 250 feet of footage because the paved street is not abutting the said property; and WHEREAS, the property benefits from the paved street and therefore should share in the cost of the project at the same rate as the majority of property owners in the assessment area; and WHEREAS, Illustration no. 8 in the Special Assessment Pro- cedures Manual of the City of Brooklyn Center states, "The footage of a residential building site with side lines which diverge from one another at the'street 20 or more shall be adjusted for assess- ment purposes. In such a case, the front footage shall be considered as equal to the building site area divided by typical depth of 135 feet, or, equal to the average front footage of those non- adjusted building sites in the block whose individual areas do not exceed the subject building; site, whichever is least. In no event, however, shall front footage be less than the actual front footage of the building site. and WHEREAS, it has been determined that the average assessable footage of non adjusted building sites in the area is 56.29 feet; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center to direct the Hennepin County Auditor to correct the street assessment as follows: Levy #4437 Street 68A -7: Original Annual 1969 1970 Assessment Correct to: Principal Installment Installment $898.83 $202.38 $28.91 $44.14 $39.37 I I I I RESOLUTION NO. 70 -51 BE IT FURTHER RESOLVED by the City Council of the City of Brooklyn Center to direct the City Treasurer to refund $151.72 to Mrs. Fred Irmen for overpayment of the street assessment on said property on the taxes payable in 1969.
