moved its adoption:
RESOLUTION NO. 70-54
RESOLUTION ALLOCATING THE BROOKLYN PARK SHARE OF
JOINT IMPROVEMENT PROJECT COSTS
WHEREAS, on June 16, 1969, the City of Brooklyn Center and the
Village (then) of Brooklyn Park did enter into an, to
cooperate in improving 73rd Avenue North between Lyndale Avenue and
Humboldt Avenue North (the boundary line between the two municipalities)
by installing sanitary water storm sewer, city water, and regrading and
resurfacing said street; and
WHEREAS, the parties mutually agreed that the sanitary sewer,
storm sewer, and water service would be provided from Brooklyn
Center; and
WHEREAS, the improvements have been completed and the City of
Brooklyn Park share of the final costs for sanitary sewer, storm sewer,
and water service, in the amount of $74,466.33 has been paid to the
City of Brooklyn Center; and
WHEREAS, on October 27, 1969, the City of Brooklyn Center and
the City of Brooklyn Park did enter into an agreement to cooperate in
the construction of a storm sewer lateral system to serve the property
within each municipality where the communities share a common boundary.
The area in Brooklyn Center is generally described as lying between
the Brooklyn Center westerly boundary and a point 310 feet east thereof
and from the centerline of 65th Avenue to a point 555 feet south of
the centerline of 65th Avenue; and
WHEREAS, the parties mutually agreed that the storm sewer was
to be provided from Brooklyn Park; and
WHEREAS, the storm sewer lateral system has been completed and the
City of Brooklyn Center share of the final costs in the amount of
$2,909.68 has been paid to the City of Brooklyn Park;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center that the Brooklyn Park contribution for its share of
costs of the joint improvement projects be allocated as follows:
1. anitary Sewer, $17,547.21:
(a) $6,680.63 to Special Assessment Fund #19 to reimburse
the Fund for construction costs. (Project 1969 -72)
(b) The balance of $10,866.58 to Special Assessment Fund
#13 (1960 AB Fund) to apply against sanitary sewer
interceptor costs.

2 Storm Sewer, $33,198.29:
(a) $11,072.87 to Special Assessment Fund x#19 to reimburse
the Fund for construction costs (Project 1969 -72)
(b) $11,480.11 to Special Assessment Fund #19 to reimburse
the Fund for construction costs (Project 1969 -66)
(c) $2,909.68 to Special Assessment Fund ##19 to reimburse
the Fund for costs paid to Brooklyn Park for the
City's share of the storm sewer lateral system
installed by Brooklyn Park.
(d) $7,735.63 to Special Assessment Fund ##13 (1960 AB
Fund) to apply against storm sewer interceptor costs.
3. Water, $23,720.83
(a) $5,733.70 to Special Assessment Fund ##19 to reimburse
the Fund for construction costs (Project 1969 -72).
(b) $17,987.13 to Special Assessment Fund ##13 (1960 AB
Fund) to apply against initial City Water System
Costs (Project 1960 -1).

The motion for the adoption of the foregoing resolution was duly
seconded by member Theodore Willard and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
