RESOLUTION NO. 70 -83
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER
MAIN IMPROVEMENT PROJECT NO. 1970 -5 AND STREET SURFACING
IMPROVEMENT PROJECT NO. 1970 -6
WHEREAS, it is proposed that there be constructed improvements
consisting of the following:

Avenue to 55th Avenue; 4th Street No. from
53rd Avenue to 55th Avenue; 55th Avenue No.
from Camden Ave. to approximately 255 feet
east of 4th Street; and 53rd Ave. No. from
Camden Avenue to 4th Street. $35,973.00
1970 -6 Street surfacing on Camden Avenue No. from
53rd Avenue to 55th Avenue; 4th Street No.
from 53rd Avenue to 55th Avenue; 55th Ave.
No. from Camden Ave. to approximately 255
feet east of 4th Street; and 53rd Ave. No.
from Camden Avenue to 4th Street. $26
WHEREAS, the City Engineer has made a preliminary report ad-
vising that said proposed improvements are feasible and that they
can be constructed at estimated costs as indicated above.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 429 Minnesota Statutes,
2. A public hearing on the proposed improvements shall be
held at the City Hall in the City on Monday, the 13th day of July,
1970, at 8:00 o'clock P.M., central daylight time,
and the Clerk shall publish notice of the time and place of hearing
by two weeks' publication in the official newspaper of the City.

3. The area proposed to be assessed for said improvements is
as follows:
ALL LOTS AND PARCELS ABUTTING THE ABOVE DESCRIBED STREETS
AND /OR TO BE BENEFITTED BY THE IMPROVEMENTS.
4. These proposed improvements shall be designated Water
Main Improvement Project No. 1970 -5 and Street Surfacing Improve-
ment Project No. 1970 -6.
BE IT FURTHER RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota, that it is hereby determined that the
properties which will be served by Water Main Improvement Project
No. 1970 -5 when said improvement is completed will also be bene-
fitted by Water Improvement No. 1960 -1, which properties were not
initially assessed for Water Improvement No. 1960 -1; and that as
to expenditures made for Water Improvement No.-1960-1 from general
ad valorem tax levies or other sources and funds in addition to
special assessments heretofore made for said improvement, the City
shall be reimbursed therefor by adding an estimated $12,407.00
to the assessment to be levied for Water Main Improvement Project
No. 1970 -5 and the City Clerk shall cause notice that such addi-
tional amount will be assessed to be included in the notice of
hearing in the making of said Water Main Improvement Project No.
1970 -5.

The motion for the adoption of the foregoing resolution was duly
seconded by member john Leary, and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary and Howard Heck;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
