moved its adoption:
RESOLUTION NO. 70 -95
RESOLUTION AUTHORIZING TEMPORARY DRIVEWAY ENTRANCE
AT SUPER VALU STORES
WHEREAS, on March 27, 1969 Super Valu Stores, Inc. filed Planning
Commission Application No. 69024 requesting approval of Site and Building Plans
for a supermarket; and
WHEREAS, Application No. 69024 was considered by the Planning
Commission on May 1, 1969 and approved by the City Council on May 5, 1969,
said Site Plans being void of any driveway entrance off Xerxes Avenue and thus
being consistent with the intended site traffic patterns recommended by the
Planning Commission and concurred in by the City Council; and.
WHEREAS, subsequent to May 5, 1969 representatives of Super Valu
Stores frequently expressed a desire for a Xerxes Avenue driveway entrance
which was unofficially reviewed by the Planning Commission and rejected; and
WHEREAS, on April 24, 1970 officials of Super Valu Stores met with the
City Manager and submitted a formal request for installation of a driveway
entrance off Xerxes Avenue for a period of four weeks to serve the anticipated
grand opening shopper volume; and
WHEREAS, installation of such a temporary driveway entrance was
authorized by the City Manager in a communication dated May 8, 1970; and
WHEREAS, Super Valu Stores filed Planning Commission Application No.
70023 on April 29, 1970 requesting a permanent driveway entrance off Xerxes
Avenue; and
WHEREAS, said Application No. 70023 on June 4, 1970 was considered
by the Planning Commission and recommended for denial by the City Council; and
WHEREAS, the City Council considered Application No. 70023 on June 24,
1970 at which time the City Manager reported that Super Valu Stores was in the
process of gathering engineering statistics relative to the need for a driveway
entrance off Xerxes Avenue; and
WHEREAS, the City Council authorized an extension of the June 16, 1970
deadline for removing the temporary driveway entrance pending preparation and
adoption of a draft resolution establishing terms for a continued extension of the
temporary Xerxes Avenue driveway entrance to permit further engineering studies:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Brooklyn Center, Minnesota as follows:

1. To acknowledge receipt of and order filed the July 1, 1970
communication from Super Valu Stores in which a formal
request is set forth to extend the existence of the temporary
driveway entrance off Xerxes Avenue until April 1, 1971 to
permit additional engineering studies;
2. It is hereby determined to authorize an extension of the
temporary driveway entrance off Xerxes Avenue until April 1,
1971 to permit gathering of engineering statistics. Immediately
after April 1, 1971, Super Valu Stores shall remove the drive-
way entrance, reinstall the street curbing, and restore the
greenstrip area. Since it has been the conclusion of the
Planning Commission and City Council that the absence of
a driveway entrance off Xerxes Avenue is in the best interest
of the public safety, the engineering statistics gathered during
the enterim period shall be analyzed and presented for City
Council consideration only in terms of the effect of the subject
driveway on the level of business activity at the Super Valu
Store

The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary, and upon vote being taken thereon, the
following voted in favor thereof: Philip Cohen, John Leary, Vernon Ausen,
Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was duly passed and adopted.
