and moved its adoption:
RESOLUTION N0. 70 -113
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY
SEWER IMPROVEMENT PROJECTS N0, 1970 -9 AND 1970 -12
WHEREAS, it is proposed that there be constructed improvements
consisting of the following:

1970 -9 Sanitary sewer in James Avenue North from
approximately 430 feet north of 65th Avenue
to 67th Avenue, and 67th Avenue North from
James Avenue to approximately 200 feet east
of James Avenue. $14
1970 -12 Sanitary sewer in Shingle Creek Parkway
from 65th Avenue North to 67th Avenue North;
on easement overlying the extension of Shingle
Creek Parkway northerly approximately 350 feet;
and on easement northeasterly for a distance
of approximately 500 feet to inplace sanitary
sewer on west line of Outlot B, Twin Cities
Interchange Park, approximately 790 feet south
of 69th Avenue North. $41,800.00
WHEREAS, the City Engineer has made a preliminary report ad-
vising that said proposed improvements are feasible and that they
can be constructed at estimated costs as indicated above.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 429, Minnesota Statutes,
2. A public hearing on the proposed improvements shall be
held at the City Hall in the City on Monday, the 31st day of
August, 1970, at 8:00 o'clock P.M., central daylight time,
and the Clerk shall publish notice of the time and place of hearing
by two weeks' publication in the official newspaper of the City.

3. The area proposed to be assessed for said improve-
ments consists of all the lots and parcels bounded and described
as follows:
Beginning at the southeast corner of Outlot A. Twin Cities
Interchange Park, according to the plat of record thereof;
thence to the northeast corner of Lot 3, Block 1, of said
plat;
thence westerly along the westerly prolongation of the north
line of said Lot 3 to its intersection with a line bearing
North 23 0 8 1 59" East, from the most southerly corner of
Tract B, Registered Land Survey No. 1274 (bearing derived
from said Registered Land Survey);
thence South 23 0 8 1 59" West to the easterly line of said
Tract B;
thence northwesterly along the easterly line of said Tract B
to the southwest corner of Tract A of said Registered Land
Survey;
thence easterly along the south line of said Tract A and the
easterly prolongation thereof to a point distant 100 feet
east of the west line of the Northeast Quarter of Section 35,
T. 119 R. 21;
thence northerly parallel with said west line to the north
line of said section;
thence easterly along said north line to the west line of
Outlot B, Twin Cities Interchange Park;
thence southerly along the west line of said Outlot B to the
southwest corner thereof;
thence easterly to the point of beginning.
4. These proposed improvements shall be designated
Sanitary Sewer Improvement Project No. 1970 -9 and Sanitary Sewer
Improvement Project No. 1970 -12,

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck, and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary and Howard Heck;
and the following voted against the same: none,
w hereupon s ai d re solution was declared duly passed and adopted.
