HomeMy WebLinkAbout1969-241 CCR Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 69 -241 RESOLUTION APPROVING PLANNING COMMISSION APPLICATION NO. 69015 SUBMITTED BY THOMAS CONSTRUCTION COMPANY, INC. WHEREAS, Planning Commission Application No. 69015 was submitted on behalf of Thomas Construction Company, Inc. requesting rezoning from the R -1 to the R -4 classification certain properties commonly described as lying between Camden and Lyndale Avenues and between 69th and 73rd Avenues North; and WHEREAS, Planning Commission Application No. 69015 was considered in public hearing by the Planning Commission on April 3, 1969 with the matter being tabled for further study; and WHEREAS, Planning Commission Application No. 69015 was studied by the Planning Commission at its meeting of April 24, 1969; and WHEREAS, at its regular meeting on May 1, 1969, the Planning Commission recommended approval of Application No. 69015 subject to the applicant amending his application to eliminate therefrom non- contiguous parcels 5630 and 5620 lying within Lot 51 of Auditor's Subdivision No. 309 and further subject to the condition that the properties comprehended by the application be platted and that the plat convey a dedication of right -of -way for Camden Avenue; and WHEREAS, in a communication dated May 2, 1969, the applicant amended his application removing therefrom non- contiguous parcels 5630 and 5620 lying within Lot 51 of Auditor's Subdivision No. 309; and WHEREAS, Application No. 69015 was heard before the City Council on May 12, 1969; and WHEREAS, upon receiving a presentation of the application and upon receiving a petition signed by twenty -two neighboring property owners favoring the proposal, the City Council instructed the City Manager to prepare a draft resolution approving Application No. 69015 requesting rezoning from R -1 to R -4, which draft resolution shall include the findings of fact enunciated by the Council: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center, Minnesota that: 1. Application No. 69015 is consistent with the Comprehensive Plan recommendation to discourage the construction of single family homes along Lyndale Avenue and along 69th Avenue; RESOLUTION NO, 69 -241 2. The applicant has adequately demonstrated that adverse soil conditions combined with severe water table conditions prevail at the site to the extent that it would be economically confiscatory to sustain R -1 zoning. BE IT FURTHER RESOLVED by the City Council to approve Application No. 69015 provided that: 1. Non contiguous parcels 5630 and 5620 lying within Lot 51 of Auditor's Subdivision No. 309 are not considered to be included in this rezoning application; 2. Properties involved in the proposed development will be platted and the right -of -way for Camden Avenue lying between Evergreen Park and the proposed development will b is d a /nQd sho non the plat. May 2 6, 1969 Date Mayor ATTEST: v Clerk The motion for the adoption of the foregoing resolution was duly seconded by member Theodore Willard, and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, john Leary, Earl Rydberg, Howard Heck and Theodore Willard; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
