Member Theodore Willardintroduced the following resolution and moved
its adoption:
RESOLUTION NO. 69 -242
RESOLUTION AUTHORIZING FILING OF APPLICATION FOR GRANT
TO ACQUIRE OPEN -SPACE LAND AND AUTHORIZING THE CITY
MANAGER TO EXECUTE SAID APPLICATION
WHEREAS, Title VII of the Housing Act of 1961, as amended, provides
for the making of grants by the Department of Housing and Urban Development
to States and local public bodies to assist them in the acquisition of
permanent interests in land for open -space uses where such assistance is
needed for carrying out a unified or officially coordinated program for the
provision and development of open -space land as part of the comprehen-
sively planned development of the urban area; and
WHEREAS, the City of Brooklyn Center (herein sometimes referred
to as "Applicant desires to acquire fee title to certain lands known as:
Parcel #1: The East 520 feet of Tract D; the East 887.60 feet of
Tract E; all in Registered Land Survey No. 235, Files of the
Registrar of Titles, Hennepin County, Minnesota.
Parcel #2: Lots 1 to 6, inclusive; Lots 8 to 12, inclusive; Lots 14 to
22, inclusive; Lots 24 to 29, inclusive; Lots 31 to 34, inclusive; all
in "Twin Lake Park" according to the plat of record on file in the office
of the Register of Deeds, Hennepin County, Minnesota. (Lots 1 -6,
8 -12, 14 -22, 24 -29, and 31 -34, all inclusive, Plat 90070, Hennepin
County)
Parcel #3: That part of Lot 22, Auditor's Subdivision Number 216
Hennepin County, Minnesota, described as: Beginning at the
Southeast corner of said Lot 22; thence south 88 degrees 00 minutes
west along the south line of said Lot 22 a distance of 505.01 feet;
thence north 17 degrees 00 minutes east a distance of 158. 55 feet;
thence north 22 degrees 00 minutes west a distance of 285 feet
to the actual point of beginning of the land to be hereinafter des-
cribed; thence south 65 degrees 00 minutes west to the shore of
Twin Lake; thence westerly and southerly along the shore of said
Twin Lake to the south line of said Lot 22; thence west along the
south line of said Lot 22 to the easterly right of way line of County
Road No. 10 (also known as Bass Lake Road) thence north and east
along the easterly and southerly right of way line of said County
Road No. 10 to a point on said southerly right of way line of County
Road No. 10 distant 565.38 feet west of the east line of said Lot 22
as measured along the southerly line of said County Road No. 10;
thence south 0 degrees 00 minutes a distance of 211.48 -feet more or
less to the actual point of beginning, according to the plat there
of on file or of record, in the office of the Register of Deeds in

and for said Hennepin County. (Part of Lot 22, Plat 891021
Reserving an easement for highway and utilities purposes for
the benefit of lands in Lot 22 retained by Jennie Skurdalsvold and
Sigrid Skurdalsvold, over the roadway as now located over the
lands hereby conveyed; the said easement to continue until such
time as the said lands shall be accessible by dedicated highway,
as shown in Deed Doc. No. 702331, Files of Registrar of Titles.
Parcel #4: That part of Tract C, Registered Land Survey No. 40,
Files of Registrar of Titles, County of Hennepin, Lying west and
south of a line described as commencing at the southwest corner
of Registered Land Survey No. 638, thence north along the west
line of said Registered Land Survey No. 638, to the south line of
the north 25 feet of said Tract A, Registered Land Survey No. 40,
thence west along last mentioned line to the extension of a line
that is 49. 51 feet west and parallel with the east line of Lot 23,
Auditor's Subdivision No. 216 or the westerly line of Tract A of
said Registered Land Survey No. 40, thence north along last
mentioned line to the north line of said Tract A, Registered Land

County, Minnesota, as Commencing at a point of intersection of
north line of said Government Lot 2 and the southeasterly line of
Lake Drive extended southerly; thence west along said north line
827.98 feet to actual point of beginning; thence south at right
angles 50 feet; thence west 100 feet; thence north 50 feet to

distant 11.95 feet; thence westerly 423. 58 feet to a point 20 feet

which land is to be held and used for permanent open -space land for park
and recreation uses; and
WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations
of the Department of Housing and Urban Development effectuating that Title,
provide that no person shall be discriminated against because of race, color,
or national origin in the use of the land acquired; and
WHEREAS, it is recognized that the contract for the Federal grant will
impose certain obligations and responsibilities upon the applicant and will
require among other things (1) assurance that families and individuals
displaced as a result of the open -space land project will be relocated into
decent, safe, and sanitary housing, (2) compliance with Federal labor
standards, and (3) compliance with Federal requirements relating to
equal employment opportunity; and
WHEREAS, it is estimated that the cost of acquiring said interests
will be $139,150, including appraisal costs:
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Brooklyn Center:
1. That an application be made to the Department of Housing and
Urban Development for a grant in an amount authorized by Title VII of the
Housing Act of 1961, as amended, which amount is presently estimated
to be $69, 575 and that the Applicant will pay the balance of the cost from
other funds available to it.
2. That the City Manager is hereby authorized and directed to execute
and to file such application with the Department of Housing and Urban
Development and to provide additional information and to furnish such
documents as may be required by said Department, to execute such contracts
as are required by said Department, and to act as the authorized corre-
spondent of the Applicant.
3. That the proposed acquisition is in accordance with the plans
for the allocation of land for open -space uses, and that, should said grant
be made, the Applicant will acquire, and retain said land for the use desig-
nated in said application as approved by the Department of Housing and
Urban Development.
4. That the United States of America and the Secretary of Housing
and Urban Development be, and they hereby are, assured of full com-
pliance by the Applicant with regulations of the Department of Housing
and Urban Development effectuating Title VI of the Civil Rights Act of 1964.

The motion for the adoption of the foregoing resolution was duly seconded by
member John Leary and upon vote being taken thereon,
the following voted in favor thereof: Philip Cohen, John Leary,
Earl Rydberg, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
