and moved its adoption:
RESOLUTION NO. 69 -342
RESOLUTION ACCEPTING WORK
(CONTRACTED BY CITY)
WHEREAS, pursuant to a written contract signed with the
City of Brooklyn Center, Minnesota, Erwin Montgomery Construction Co.
has satisfactorily completed the following improvement in accord-
ance with said contract:
Sanitary Sewer Improvement Project No. 1969 -61 (Contract 1969 -B)
Irving Ave. No. from 70th Ave. to 71st Ave.; and 70th Ave. No.
from Irving Ave. to James Ave.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved.
2. The value of work performed is less than the original
contract amount by $388.82 because of general overestimating of
plan quantities.
3. It is hereby confirmed that final payment has been satis-
fied on said contract on November 24, 1969 taking the contractor's
receipt in full. The total amount paid for said contract for said
improvement project was $5,553.18.

The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck, and upon vote being taken
thereon, the following voted in favor thereof: Philip Cohen,
John Leary, Earl Rydberg, Howard Heck and Theodore Willard;
and the following voted against the same: none,
whereupon said resolution was declared duly passed and adopted.
