HomeMy WebLinkAbout1969-349 CCR Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 69 -349 RESOLUTION RELATIVE TO SUBDIVISION BOND FOR NAZARENE ADDITION PLAT 2 AND THOMAS CONSTRUCTION CO. 2ND ADDITION WHEREAS, on August 26, 1968, a subdivision bond in the amount of $7,000.00 was posted to guarantee certain subdivision improvements in the "Nazarene Addition Plat 2 and WHEREAS, on August 26, 1969, an agreement was received which assigned the above subdivision obligations to the Thomas Construction Co., Inc., a Minnesota corporation, and WHEREAS, a certified check in the amount of $7 was received with the above said assignment agreement, which check was deposited in the Investment Trust Account of the City, and WHEREAS, the "Thomas Construction Co. 2nd Addition" plat effects the replatting of a substantial portion of the "Nazarene Addition Plat 2" and eliminates the further need for subdivision bonding for the "Nazarene Addition Plat 2 and WHEREAS, certain bond requirements in the amount of $3,000.00 are generated by the platting of the "Thomas Construction Co. 2nd Addition NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brooklyn Center as follows: 1) To retain $3,000.00 to guarantee the improvements for the "Thomas Construction Co. 2nd Addition" as set forth in the Financial Performance Guarantee by Developer or Contractor dated December 16, 1969. 2) To direct the City Treasurer to return to the Thomas Construction Company the surplus cash escrow in the amount of $4 December 29, 1969 Date /,r Mayor ATTEST: a vft Y Deputy Cl�rk w The motion for the adoption of the foregoing resolution was duly seconded by member Earl Rydberg and upon vote being taken thereon, the following voted in favor thereof: Philip Cohen, John Leary, Earl Rydberg, Howard Heck and Theodore Willard; and he following voted against the same: none, whereupon said resolution was declared duly passed and adopted.
